J.Crew factory class action lawsuit overview: 

  • Who: Dani Calderon and Evguenia Babaeva filed a class action lawsuit against J.Crew Group LLC. 
  • Why: Calderon and Babeva claim J.Crew falsely advertises “comparable prices” that mislead consumers about the value of sales on J.Crew and J.Crew Factory clothing line products. 
  • Where: The class action lawsuit was filed in California federal court.

J.Crew falsely advertises its J.Crew clothing line as comparable to its J.Crew Factory line when promoting “comparable value” prices at its retail locations or online store, a new class action lawsuit alleges. 

Plaintiffs Dani Calderon and Evguenia Babeva claim J.Crew is misleading consumers with the “comparable value” prices since its J. Crew line is allegedly of higher quality than its J. Crew Factory line. 

Calderon and Babeva argue J.Crew is ultimately deceiving consumers into believing “they are receiving a bargain on their purchases to induce them into making purchases they otherwise would not have made.” 

“In an effort to give off the appearance of a bargain, Defendant intentionally misleads consumers as to the quality and value of the merchandise available on its website and in its retail stores … through its deceptive sales tactics,” the J.Crew class action states. 

Calderon and Babeva want to represent a nationwide class and California subclass of consumers who purchased J.Crew and J.Crew Factory products during the applicable statute of limitations period. 

J.Crew engages in false reference pricing with ‘comparable value’ prices, class action says

Calderon and Babeva claim J.Crew is engaging in what is known as false reference pricing, which they argue is a violation of both state and federal law. 

“Plaintiffs and members of the Class, as defined herein, were induced into purchasing the Products under the false premise that they were of a higher grade, quality, or value than they actually were,” the J.Crew class action states. 

Calderon and Babeva claim J.Crew is guilty of unjust enrichment and fraud, and of violating California’s Unfair Competition Law, False Advertising Law and Consumer Legal Remedies Act

Plaintiffs are demanding a jury trial and requesting an award of declaratory and injunctive relief along with an award of treble and punitive damages for themselves and all class members. 

A separate class action lawsuit was filed against J.Crew in 2018 by a consumer arguing the company used deceptive advertising to make customers believe they are getting better deals on sales than they actually are.

    How do you sign up? I was a resident of California during the time period and shopped at the San Jose J Crew outlet many times. I also have the digital receipts still available.
