senior man in hospital bedThousands of lawsuits have been filed against Monsanto with allegations of Roundup cancer, but as a settlement agreement has not yet been reached, another Roundup lawsuit is heading to trial.

The lawsuit approaching trial was filed against Monsanto (now owned by Bayer AG) by cancer patient Victor B. and his wife Linda, who allege that the man’s critical cancer was caused by years of exposure to Monsanto’s Roundup weedkiller.

The trial is set to begin on May 5 in Marin County Superior Court in California. This particular Roundup lawsuit, while many others may have taken longer to reach trial, was granted preference status, moving the trial date up, because Victor is critically ill.

Now in his 70s, Victor was diagnosed with Stage IV T-cell non-Hodgkins lymphoma. Multiple rounds of chemotherapy failed, so Victor is set to undergo a bone marrow transplant in March.

Victor used Roundup for decades, between 1989 and 2017, according to his lawsuit. This exposure to Roundup led to his cancer diagnosis, his lawsuit alleges. His wife is also named as a plaintiff in the lawsuit, with claims of loss of consortium and other damages.

Roundup Dangers?

The World Health Organization has found Roundup’s main active ingredient, glyphosate, to be a human carcinogen—that is, capable of causing cancer in humans—though the EPA says there is no connection and Bayer continues to maintain that glyphosate is safe.

Bayer is attempting to get a handle on the thousands of lawsuits it faces—which some sources say involves somewhere above 100,000 plaintiffs. The company is attempting settlement talks here and there, but other trials are going forward, which may indicate the severity of the lack of agreement between the company and the plaintiffs filing against it.

So far, a comprehensive settlement agreement has not been reached.

Potential settlement discussions have postponed trials; settlement totals for outstanding claims between $8 billion and $10 billion have been talked about in the last few weeks. Notably, claims of Roundup injury have followed Bayer since the company bought Monsanto in June 2018 for $63 billion.

Even if Bayer settles litigation from this current pool of plaintiffs, it will not protect the company from future litigation. The Wall Street Journal notes that Bayer has an “extraordinary challenge” ahead of it—especially considering Roundup itself remains on the shelves.
