mojo marinadeA company claiming to be the first of its kind to produce an authentic Cuban marinade for sale in the U.S. now faces a class action lawsuit over the use of the term “all natural.”

The Natural Mojo Marinade class action filed by lead plaintiff Thomas Williams alleges that the use of citric acid and canola oil negates the company’s claims that the bottles contain only all natural and non-preservative ingredients.

The Natural Mojo Marinade is made by Le Lechonera Products Inc., a business founded in 1970 and one that previously ran a restaurant using the popular marinade.

The sale of the bottled marinade is new, promising buyers that they will get “the same great flavor” of the original restaurant marinade without any “msg, preservatives, or artificial colors.”

The Natural Mojo Marinade class action lawsuit says that this is false advertising, since consumers rely on the wording of labels to make informed decisions about the products they purchase.

According to the plaintiff, claiming that the products are made with only natural ingredients and promising no preservatives is misleading since further examination reveals processed items such as canola oil.

The Natural Mojo Marinade class action lawsuit argues that the use of the terms on the label would cause any reasonable consumer to draw the conclusion that the products don’t have artificial, synthetic, or genetically modified ingredients.

Despite this labeling choice, however, the product contains citric acid and canola oil.

The plaintiff in the Natural Mojo Marinade class action lawsuit says citric acid is manufactured in an industrial process that is unnatural and that canola oil is highly processed.

As alleged in the Natural Mojo Marinade class action lawsuit, the FDA states that citric acid is a preservative.

The plaintiff in this Natural Mojo Marinade class action lawsuit argues that he bought the product from two different stores in Miami and relied on the labels as a health-conscious consumer.

He says the labels led him to believe that he was buying a healthy and non-processed product.

The Natural Mojo Marinade class action lawsuit seeks to represent Florida purchasers of the Le Lechonera product during the four years leading up to the filing of the lawsuit. The products involved include the marinades with the word “natural” on the label.

The Natural Mojo Marinade class action lawsuit lead plaintiff says that there are at least 100 consumers affected by this false advertising, making the case appropriate for class action certification.

The lawsuit against Le Lechonera says that the company is responsible for breach of express warranty, unjust enrichment, and violations of Florida’s Deceptive and Unfair Trade Practices Act.
