A $725,000 settlement has been proposed to resolve claims against FCH Enterprises regarding a Zippy’s Restaurants data breach that occurred between 2017 to 2018.
FCH Enterprises owns Zippy’s Restaurant, Napolean’s Bakery, Kahala Sushi, Pear City Sushi, and Pomaika’i Ballrooms, which were reportedly subject to a widespread data breach between Nov. 23, 2017 and March 29, 2018.
The Zippy’s Restaurants data breach may have compromised payment card data including credit card numbers, expiration dates, and magnetic stripe security codes.
Consumers who used a credit or debit card at any of FCH Enterprises’ locations during the Zippy’s data breach may be eligible to recover up to $7,500 in compensation.
The amount of compensation each Class Member will recover depends on how they were affected by the breach and what, if any, out-of-pocket expenses they incurred as a result of the Zippy’s Restaurants data breach.
Class Member have until June 2, 2019 to submit a valid Claim Form. Claim Forms for the Zippy’s data breach settlement can be submitted online or printed off the settlement website and mailed to the settlement administrator.
If Class Members wish to object to or opt out of the Zippy data breach settlement, they have until April 3, 2019 to do so.
Who’s Eligible
Customers who used a credit or debit card at Zippy’s Restaurants, Napolean’s Bakery, Kahala Sushi, Pear City Sushi, and Pomaika’i Ballrooms between Nov. 23, 2017 and March 29, 2018.
Potential Award
Several options for compensation:
- Basic Award: $10; available every Class Member.
- Expense Reimbursement Award: $30 for inconvenience and up to $170 for out-of-pocket expenses; eligible for Class Members who had unauthorized charges (that were denied or reimbursed) which they believe were caused by the security breach.
- Extraordinary Expense Reward: Up to $7,500 to reimburse unauthorized charges which were not denied or reimbursed, lost time spent dealing with the issue, and out-of-pocket expenses; eligible for Class Members who have exhausted all available credit monitoring insurance and identity theft insurance.
Proof of Purchase
Class Members who are claiming either an Expense Reimbursement Award or an Extraordinary Expense Award will need to provide documentation that unauthorized charges were made such as a bank or credit card statement.
