The maker of XHose has agreed to settle a class action lawsuit stemming over allegations that the company falsely advertised the durability of its expandable hose products.

The nine plaintiffs who filed the XHose class action lawsuit claimed that the manufacturer is liable for violations of express and implied warranties by marketing the product as being made from a super-strong design.

According to the lawsuit, the XHose Pro is advertised as being “made from a tough, multi-layered expandable inner hose and a folded outer covering made from durable super-strong webbing” that never kinks.

However, the plaintiffs allege that the XHose is actually prone to developing leaks, rips, breaks, cracks and even explodes after minimal use.

The defendants deny all accusations of wrongdoing but agreed to the terms of the settlement to avoid the cost of further litigation.

Class Members who wish to object or be excluded from the settlement must do so by June 20, 2016.

Who’s Eligible

Class Members include all individuals who bought an XHose in the U.S. between Jan. 1, 2012 and Dec. 29, 2015.

Potential Award

Varies.

The XHose class action settlement provides benefits for both direct and non-direct purchasers.

Direct buyers are those who purchased the product directly from www.xhose.com or by calling the toll-free number in response to a TV advertisement. Those who fit into this group can make a claim for one of the following:

  • Warranty extension of 270 days from the date of purchase
  • $15 for each hose up to $45 per person
  • Those who return the male and female XHose end fittings may receive $30 for each purchase

Non-Direct purchasers are individuals who purchased an XHose from a retail store or website other than www.xhose.com. Non-Direct buyers can make a claim for one of the following:

  • $8 per person
  • Those who return the male and female XHose end fittings may receive $30 for each purchase, up to a max of $90 per person

Class Members don’t have to provide a proof of purchase but they must submit a valid Claim Form no later than Aug. 29, 2016 to receive benefits from the XHose class action settlement.

    The Court gave final approval of the settlement on July 28, 2016. It is anticipated that checks will be mailed for claims determined to be valid in approximately ninety (90) days.

    hello,

    I’m on my 6th hose, every time it would leak. I would take it back to Home Depot where i originally purchased it, who gave me another one at no charge. They told me they have lots returned?

    Like the concept If they can get to work has advertised?

      Why did you bother to keep getting another one. The first one should have told you it was junk. We all found out that they were useless.
