Amalie Oil Company recently agreed to a class action settlement to resolve claims that their XCEL motor oil is obsolete and capable of severely harming vehicle engines.
The settlement will benefit consumers who purchased XCEL premium motor oil between Dec. 1, 2014 and Oct. 11, 2019.
Plaintiffs filed their XCEL motor oil class action lawsuit in August 2018, alleging that Amalie essentially sells their consumers cancer for vehicles.
The oil products reportedly lack the additives which are commonly found in motor oils to protect the vehicles. As a result, this “base oil” can allegedly lead to serious problems including catastrophic engine failure.
The American Petroleum Institute has reportedly declared these and other base oils to be obsolete. The institute allegedly warns consumers against using these products due to the risk of damaging their vehicles beyond repair.
Amalie Senior President of Sales and Marketing Dennis J. Madden acknowledged that the products are like cancer to cars, but reportedly said in a 2003 interview that “as long as people are going to buy non-detergent oils, and other companies are going to sell them, we feel like we have to compete.”
The company has not admitted any wrongdoing but has agreed to settle the XCEL motor oil class action claims against them.
Under the settlement, Class Members can collect up to $5 per quart if they provide proof of purchase. These Class Members can claim up to four quarts per household, resulting in up to $20 in cash payments.
Even if Class Members do not have proof of purchase, they may be able to recover compensation as well. Consumers with no proof of purchase can collect up to $2 per quart. These Class Members are able to claim up to three quarts per household, for up to $6 in total cash payments.
In order to receive benefits under the settlement, consumers need to file a valid Claim Form by Feb. 12, 2019. The deadline for exclusion and objection is Jan. 8, 2020. The final approval hearing is scheduled for Jan. 23, 2020.
Who’s Eligible
Consumers who purchased XCEL premium motor oil between Dec. 1, 2014 and Oct. 11, 2019.
Potential Award
Up to $2 per quart with no proof of purchase with up to three quarts claimable per household (up to $6). Up to $5 per quart with proof of purchase, with up to four quarts claimable per household (up to $20).
Proof of Purchase
Not required but receipts from purchases can help Class Members collect higher payments.
