Wish.com operator ContextLogic has agreed to pay $16 million to resolve claims that they violated federal law by sending unsolicited advertising text messages.

The settlement will benefit people who were sent one or more text messages from Wish.com operator ContextLogic between April 6, 2014 and Sept. 24, 2019. Consumers are not eligible for the settlement if they consented to receive texts from Wish.com on or after April 26, 2018.

The Wish.com class action lawsuit alleged that the company sent consumers unsolicited text messages advertising their Wish.com service and other e-commerce marketplaces.

According to the Wish.com class action lawsuit, these text messages violated the Telephone Consumer Protection Act (TCPA). The TCPA is a federal law that prohibits businesses from sending unsolicited communications for telemarketing purposes. This includes spam texts, robocalls, and junk faxes used to advertise a good, service, or promotion.

ContextLogic has not admitted any wrongdoing by settling the Wish.com class action lawsuit against them. Instead, all parties have agreed to the settlement to resolve the claims and avoid the costs and risks associated with continuing litigation.

Class Members will receive an equal share of the net settlement fund after attorneys’ fees, administrative costs, court costs, incentive awards, and other fees are deducted from the $16 million. Exact payment amounts are unknown but Class counsel estimates that each claimant will receive between $45 and $50.

If consumers wish to have their settlement payment deposited in “Wish Cash” to their Wish.com account, they will receive a 50 percent off discount code to be used on the first $20 of any single purchase of goods from Wish.com.

In order to benefit from the settlement and receive payment, Class Members need to file a Claim Form by Feb. 25, 2020. The deadline for exclusion and objection is Dec. 9, 2019. The final approval hearing for the settlement is scheduled for Jan. 7, 2020.

Who’s Eligible

People who were sent one or more text messages from Wish.com operator ContextLogic between April 6, 2014 and Sept. 24, 2019. Consumers are not eligible for the settlement if they consented to receive texts from Wish.com on or after April 26, 2018.

Potential Award

Between $45 and $50 (estimate).

In addition, consumers can also receive a 50 percent off discount code to be used on the first $20 of any single purchase of goods from Wish.com if they choose to have their payment deposited into their Wish.com account as “Wish Cash.”

    I’m frickin upset with these people. I haven’t received my check and they haven’t responded to my emails. There is no way that they denied cuz that would mean that half the people shouldn’t have gotten a check.
