A $35.4 million settlement will resolve claims that Wisconsin HealthPort illegally charged for medical record requests.
Those who were forced to pay a fee by Ciox, IOD, HealthPort, Aurora or Columbia St. Mary’s between July 1, 2011 and Aug. 1, 2019 in order to receive medical records in Wisconsin are Class Members and may benefit from this settlement.
Fees covered in the settlement include basic, retrieval, or certification fees. Class Members include patients who requested their own medical records as well as those who requested records on behalf of another.
Plaintiffs accused HealthPort Technologies and Aurora Healthcare of charging fees for access to medical records in violation of Wisconsin state law.
According to the Wisconsin HealthPort medical record class action lawsuit, the company slapped a $22.58 fee on medical records requests.
Fees were allegedly charged both to those who wanted to access their own records, as well as to those who were authorized to access medical records on behalf of another. Under Wisconsin law, every patient has a right to see and get a copy of their medical record.
According to George Washington University’s Health Information & the Law project, medical providers can charge a reasonable fee, including copying and postage costs, for these records.
The plaintiffs in the Wisconsin HealthPort medical record class action lawsuit contend that HealthPort and Aurora overcharged for access to these records.
HealthPort and Aurora agreed to settle the medical records class action lawsuit, noting that there was ambiguity as to whether they would succeed at trial.
Under the terms of the Wisconsin HealthPort medical record class action, those who paid a fee to access health records will be able to make a claim for a cash payment totaling approximately twice the amount they paid in fees.
Class Members who were charged a fee for accessing their own health records from Ciox, IOD, HealthPort, Aurora or Columbia St. Mary’s between July 1, 2011 and Aug. 1, 2019 will need to submit a Claim Form online or via mail with their Class Member identifier.
Those who requested medical records as an authorized representative of another and were charged a fee covered by the settlement will need to submit a Claim Form with their Class Member identifier and the invoice number related to the assessed fee.
The deadline to object to or opt out of the settlement is Oct. 7, 2019.
Who’s Eligible
“Any Person who, from July 1, 2011 through the August 1, 2019: (i) paid a basic, retrieval and/or a certification fee charged by Ciox, IOD, HealthPort, Aurora or Columbia St. Mary’s, in violation of [Wisconsin state law]; and who (ii) has not already been reimbursed for such basic, retrieval and/or certification fees.”
Potential Award
Varies. Claims will depend on the fees paid for each Class Member and are expected to total twice the amount charged to each claimant.
Proof of Purchase
Class Member identifiers from the Notice are required. Those who requested medical records as an authorized representative of another will need to provide a unique invoice number associated with the charged fees, along with the Class Member’s identifier and claimant’s tax payer identifier.

I originally was sent an email. I then received a letter with a W-9 form that was needed because the amount was more than $600. The letter stated that I should have received two settlement payments. They needed the form back by October 10, 2020, so they could start sending payments. I got in touch with them on 10/15/2020 and they stated the Settlement Administrator was just starting to process the payments. The law office told me 60 – 90 days. This is starting to feel like a scam, or we will get a check for $10.00 because of all the “administrative” fees. Another hurry up and wait situation.
It is beginning to feel like this enormous amount of money is sitting somewhere and collecting a lot of interest for someone!
I selected Zelle to get my payment. I think it arrived today, but was short $150.23 – I was supposed to get $1251.88 and got $1101.65
When did you let them know you wanted it like that when you got the postcards because I let them know how one of my payment when I got the postcards that I filled out
When did you get the letter
I just received a response from the administrator. Now they are saying the distribution date is “tentatively set for NOVEMBER” This is ridiculous! The changing of the distribution dates is very frustrating! Why don’t they just give us a date and stick go it!!!
Still waiting. My letter said I should get two payments of $625.94 and I received NOTHING to date. Anyone have any updates?
When did you get the letter
I sent an email to the administrator today asking, since it is the end of October, if they have an exact distribution date. Will post the response of any concrete date as soon as they reply.

Where did you hear that you should have received a check by the October 20th? The administrator said “tentatively by the end of October” which means it may even be November before payments are distributed.

Good morning everyone has anyone got updates besides the email I just posted that I got back in September and when I sent my card in my postcard in I have two of them I set up my direct deposit then on which on how I wanted it to come back to me. I got two postcards with two different account numbers on it or claim numbers should I say and at that time when I registered stay in the lawsuit I’ll set up my direct deposit then the anyone do the same thing.
They were supposed to send them out no later than October 10th now its changed again, this is the email I recieved the other day:

Unless someone else has a more recent update from the administrator, the latest information is in my post from October 7th. For some reason the posts are not in date order, so you may have to scroll down to read it.

The administrator replied to my request of an exact distribution date by now saying the date has been “tentatively set for November”. Same old, same old response…another extension! This is getting old quickly. Why don’t they just give us a date and stick to it? Why are they continually changing it? This is so frustrating!

According to the paperwork I received, the claimants needed to pick the way that they wished to be paid ( pay-pal, check or direct deposit ) no later than September 10,2020 so payments could be sent by October 10,2020

I just received an email from the settlement administrators and it read that payment distribution was “tentatively set for the end of October”. They did not give an exact date, so it may be even longer than the end of October. It is so frustrating that the dates keep changing. These postponements are ridiculous!
