A $35.4 million settlement will resolve claims that Wisconsin HealthPort illegally charged for medical record requests.
Those who were forced to pay a fee by Ciox, IOD, HealthPort, Aurora or Columbia St. Mary’s between July 1, 2011 and Aug. 1, 2019 in order to receive medical records in Wisconsin are Class Members and may benefit from this settlement.
Fees covered in the settlement include basic, retrieval, or certification fees. Class Members include patients who requested their own medical records as well as those who requested records on behalf of another.
Plaintiffs accused HealthPort Technologies and Aurora Healthcare of charging fees for access to medical records in violation of Wisconsin state law.
According to the Wisconsin HealthPort medical record class action lawsuit, the company slapped a $22.58 fee on medical records requests.
Fees were allegedly charged both to those who wanted to access their own records, as well as to those who were authorized to access medical records on behalf of another. Under Wisconsin law, every patient has a right to see and get a copy of their medical record.
According to George Washington University’s Health Information & the Law project, medical providers can charge a reasonable fee, including copying and postage costs, for these records.
The plaintiffs in the Wisconsin HealthPort medical record class action lawsuit contend that HealthPort and Aurora overcharged for access to these records.
HealthPort and Aurora agreed to settle the medical records class action lawsuit, noting that there was ambiguity as to whether they would succeed at trial.
Under the terms of the Wisconsin HealthPort medical record class action, those who paid a fee to access health records will be able to make a claim for a cash payment totaling approximately twice the amount they paid in fees.
Class Members who were charged a fee for accessing their own health records from Ciox, IOD, HealthPort, Aurora or Columbia St. Mary’s between July 1, 2011 and Aug. 1, 2019 will need to submit a Claim Form online or via mail with their Class Member identifier.
Those who requested medical records as an authorized representative of another and were charged a fee covered by the settlement will need to submit a Claim Form with their Class Member identifier and the invoice number related to the assessed fee.
The deadline to object to or opt out of the settlement is Oct. 7, 2019.
Who’s Eligible
“Any Person who, from July 1, 2011 through the August 1, 2019: (i) paid a basic, retrieval and/or a certification fee charged by Ciox, IOD, HealthPort, Aurora or Columbia St. Mary’s, in violation of [Wisconsin state law]; and who (ii) has not already been reimbursed for such basic, retrieval and/or certification fees.”
Potential Award
Varies. Claims will depend on the fees paid for each Class Member and are expected to total twice the amount charged to each claimant.
Proof of Purchase
Class Member identifiers from the Notice are required. Those who requested medical records as an authorized representative of another will need to provide a unique invoice number associated with the charged fees, along with the Class Member’s identifier and claimant’s tax payer identifier.

On August 11, 2020, I got an email stating how much I was supposed to get along with choosing a reimbursement payment option. That option had to be selected by September 10, 2020. Has anyone else received further information than this? I’m hoping distribution will be soon since everyone was supposed to have selected their payment option by last week.
No later than October 10,2020
What’s they say now
Has anyone know anything about the payment supposed to went out.
Can I get an update as to when claims are going to be paid?
Thank you
The lawyer said payments should go out in August
When are the checks coming out in August
I just sent the administrators an email to see if the checks were actually going to be sent out in August. I will update here as soon as I receive an answer.
Well did they say anything is September now and they say how much we going to get.
I just got an email from the administrators and I quote “the exact distribution date has yet to be scheduled but it will be after the September 20, 2020 payment option deadline. Please be patient.” Doesn’t sound promising and I do not know much about these things, but I would think they would have to payout BEFORE the September deadline, not after it! Can anyone at TCA explain? Thanks!
Any new updates? Does anyone know if checks went out on the 23rd? This seems like a long time since the final approval was mid- November. Maybe pandemic related, who knows…any update would be appreciated!
I sent an email, I’m just waiting on a response
Thanks! Please post an update if you get a response. This is the only way that I can find out what is going on, so it is very helpful!
This is what they sent in the reply email

Thank you for relaying their response. It is so unfortunate that, after all this time, they can’t provide us with a more accurate answer! Thanks again for trying! If anyone else has an update or actually receives a check, please let us know! Thanks again to all!
I just got a general canned response about the court dates and how they are currently reviewing submitted claims and to please be patient ?
It is now June, has anyone received the payment that was supposed to be sent in May? If not, are there any updates on an accurate date for the distribution of the funds?
Read somewhere that the payment would be sent out around June 23rd 2020. Keep in mind that this is the third date ive seen so I have no idea which one is completely accurate
Thank you for your response.
I’m curious to know has anyone received a check ?I keep getting an email from some automated responder saying june23 but nothing yet. They haven’t said an exact payment amount or will we even be paid.
Paying out in August 2020 according to lawyer it took longer due to covid 19
Email from lawyer says June 23rd
when do we get paid
Lawyers said checks should go out in May 2020
When will claims be paid out
When do the payments come out? There website and phone number say nothing.
When do we get paid for this class action lawsuit
