Werner Co. has agreed to settle a class action lawsuit involving allegations that it made and marketed steel attic ladders with defective parts. If you currently own a steel “Easy Access Attic Ladder” in model numbers S2208 and S2210, Marks 1, 2, 3 or 4, you may be eligible to receive a new Werner wood or aluminum attic ladder from the class action settlement.
Who’s Eligible
Class Members of the Werner attic ladder class action settlement include all individuals or entities in the United States who currently own a Werner Model S2208 or S2210 steel attic ladder designated as Marks 1, 2, 3 or 4.

Proof of Purchase
Required. You must submit a receipt or other proof of purchase showing you purchased a Werner S2208 or S2210 attic ladder with a date of purchase between September 2003 and September 2005; OR the label affixed to the inside portion of the wooden door of my Werner S2208 or S2210 attic ladder. The label must show “Mk 1,” “Mk 2,” “Mk 3,” or “Mk 4” immediately below “S2208” or “S2210.”

Case Summary
If approved, the Werner attic ladder settlement will resolve a class action lawsuit (Clemans v. New Werner Co.) that alleges Werner made and marketed a steel “Easy Access Attic Ladder” with defective zinc hinges that are prone to breaking and shearing while the ladders are being used.
Werner has denied the allegations but agreed to settle the class action lawsuit to avoid the expense and risk of trial.

Wow. Broke a step and just about fell. Like other comments, no notice of any settlement. I want mine replaced.
Same issue here! I had no idea of any law suit or recall until my S2208 Mk2 ladder hinge broke as I was descending from the attic and then went online to search for replacement parts. I have reached out to Werner and am hoping that they will offer some assistance.
I had a plumbing contractor fall as he stepped down on the bottom step. It mirrors what I’ve been reading on this website. How were we supposed to know about the class action lawsuit??
11/27/20- While putting chairs up in to the attic the pot metal hinge on the bottom section failed while I was on it, causing me to fall jamming a chair leg into my stomach and fall off the ladder. I am sore and will be bruised, they will hear from me on this…
Anyone whose Werner Co attic ladder stairs break, AFTER the settlement, should call their customer service line and file the incident. Not sure what they will do, but atleast they will know the problem still exists.. Their customer service area can be reached at 1-888-523-3370. Good luck! Fingers crossed they help us out, after the hinge broke on my husband, while he was carrying a box of decorations and our kids were already up in the attic, ready to help. Thank goodness he wasn’t hurt! Could have been MUCH worse.
I just called them this morning, they’re offering a $50 Home Depot voucher but that’s it at this point. I told them to keep the $50, I’ll pay full price for a competitor’s model. Agent told me to have a good day. They don’t care.
2/1/20- my S2210 mk2 lower section sheared off while I was on the third step and my hands were full. Rt. foot landed on the stair rung facing vertical. Ended up in the er with a broken foot.
Similar thing happened to my husband the other day. We found the class action info when looking for replacement parts. He had me call Werner Co customer service. I suggest you do the same. Not sure what will come of it, but atleast they can document additional incidents. Their # is 1-888-523-3370.

Damn..damn..damn!!! One of the lower hinges just broke!! So much for getting some money for this garbage product!!
I too just cratered off this S2210 Werner ladder when the bottom rung hinges broke. Wish I had known about the class action suit in time.
Same thing just happened to me climbing up gratefully with nothing in my hands, so avoided any injuries. Snapped out the lower ladder hinge, right side first followed very shortly by the left side. I have the S2210 Mark 2, unfortunately will probably not get any kind of compensation for this.
Anybody come up with a replacement that isn’t a Werner? After reading these messages this is my last Werner ladder.
Same thing just happened to me two days ago. Just bought my house three years ago and thought the ladder was heavy duty bulit till this. Now I’m looking for replacement parts also.
My lower section hinge just broke also! Snapped while my wife was carrying some Halloween decorations down, damaged the wood floor and fortunately not her. Now cannot return the “stuff” to hiding in the attic! Is there a exact replacement for this to fit in the same opening?
