Wells Fargo Bank NA has agreed to settle a class action lawsuit accusing it of violating the Telephone Consumer Protection Act (TCPA) by contacting consumers’ cell phones without their prior express consent.

If you received a call or non-emergency text message from Wells Fargo in connection with a residential mortgage or home equity loan, you may be entitled to payment from this Wells Fargo class action settlement.

The proposed Wells Fargo settlement will resolve a class action lawsuit that alleges the bank violated the TCPA by using an automatic telephone dialing system and/or artificial or prerecorded voice to place calls or send non-emergency texts to cell phones in connection with residential mortgage and home equity loan accounts.

The TCPA class action lawsuit asserts Wells Fargo made the calls or texts without the prior express consent of the recipients in violation of the TCPA.

The Telephone Consumer Protection Act is a federal law that prohibits companies from placing phone calls and text messages using an automatic telephone dialing system, artificial or prerecorded voice to consumers who have not consented to receive the calls or texts.

Wells Fargo denies the allegations but agreed to settle the TCPA class action lawsuit to avoid the expense and uncertainty of trial. Wells Fargo has agreed to pay more than $16.3 million to resolve the litigation.

If the Wells Fargo TCPA settlement is approved, it will resolve all claims in the following class action lawsuits: Markos v. Wells Fargo Bank NA, Page v. Wells Fargo Bank NA and Davis v. Wells Fargo Bank NA.

If you would like to opt out of or object to the Wells Fargo TCPA class action settlement, you must do so no later than Nov. 22, 2016.

Who’s Eligible

You are a Class Member of the Wells Fargo TCPA settlement if you subscribed to a wireless or cellular service and you received a call or non-emergency text message from Wells Fargo that was made using an automatic telephone dialing system or prerecorded voice.

The Court has certified the following subclasses:

Subclass One: Includes Class Members who used or subscribed to a cellular phone number to which Wells Fargo initiated a call or non-emergency text in connection with a residential mortgage loan from Nov. 17, 2011 to Feb. 29, 2016.

Subclass Two: Includes Class Members who used or subscribed to a cellular phone number to which Wells Fargo made or initiated a call or non-emergency text in connection with a home equity loan from April 14, 2011 to Feb. 29, 2016.

Potential Award

$25 – $75 (estimated).

The amount each claimant will receive from the Wells Fargo TCPA class action settlement depends on the total number of timely and valid Claim Forms that are filed.

    I received one Saturday for $61.08 Called Wells Fargo they don’t know anything about it gave me a number they put me on hold and never came back

    I received my daily email from USPS.com showing what mail was to arrive today. Of course everything came but my check. It’s missing. Submitted a missing report.
    Guess if it doesn’t arrive by Monday I’ll have to call the claims administrator to see if they can send a duplicate check since my post office said there isn’t anything they can do.
    Why is it all the rest of my mail came but not the check??!!

      I see one too today in informed delivery. Must be a second distribution as these were issued in 2017.

      I think you can inform usps via that same informed delivery email, to report you haven’t seen it.

      I also see a letter for me via usps informed delivery, sure looks like it must be a check in Wisconsin

      Got one today and went to wells fargo bank and they said it’s not one of there checks and refused to cash it anyone know We’re to go or what to do to get the check cashed it is ours and now we are having issues to cash it don’t think its fair
