Wells Fargo TCPA settlement

Wells Fargo Bank NA has agreed to settle a class action lawsuit alleging it violated the Telephone Consumer Protection Act (TCPA) by using an automatic telephone dialing system and/or artificial or prerecorded voice to contact consumers on their cell phones.

If you received a call or text message on your cell phone from Wells Fargo regarding an overdraft between Apr. 21, 2011 and Dec. 19, 2015, and the call or text was made using an automatic telephone dialing system and/or artificial or prerecorded voice, you may be entitled to compensation from the TCPA class action settlement.

Wells Fargo denies that it made any illegal calls or texts but agreed to pay more than $30.4 million to settle the TCPA class action lawsuit.

If approved, the proposed Wells Fargo settlement would resolve a TCPA class action lawsuit filed in April 2015 by plaintiff Kenisha Cross. She claims that she received multiple non-emergency calls from Wells Fargo that were made without her prior express consent.

According to the Wells Fargo class action lawsuit, the calls and text messages were made using an automatic telephone dialing system and/or artificial or prerecorded voice. Cross asserts that these calls and texts violated the TCPA.

The TCPA provides for damages of $500 per violation or up to $1,500 for willful violations. It also provides for injunctions that limit future conduct from those found to have violated the TCPA.

If you would like to object to or exclude yourself from the Wells Fargo TCPA class action settlement, you must do so no later than Dec. 16, 2016.

Who’s Eligible

Under the terms of the Wells Fargo TCPA settlement, Class Members are defined as: “all users or subscribers to a wireless or cellular service within the United States who used or subscribed to a phone number to which Wells Fargo made or initiated one or more Calls during the Class Period, in connection with overdrafts of deposit accounts, using any automated dialing technology or artificial or prerecorded voice technology, according to Wells Fargo’s available records.”

The Class Period is Apr. 21, 2011 through Dec. 19, 2015.

Potential Award

$25 – $70 (estimated)

The actual amount each claimant will receive depends on the total number of valid and timely claims filed by all Class Members.

      Sign the back of “check” post card anywhere.. my bank always cash them with.. no problems.. hope that helps…

        Sunshine is correct. Sign on the back of the check roughly were you would endorse on a regular check. If you look closely you may even see a very slight line which to endorse on. It’s hard to see sometimes.

      You’re posting on the wrong settlement. This is cross v. wells fargo. You recieved marcos v wells fargo. This settlement has not paid out yet.

        No. She is correct. I also got my $18 check yesterday for THIS class action for Robo calls.

          Usually when checks arrive the TCA facebook page has many people posting that they received a check and/or post a picture of it. The comments sections of the TCA page (this page your on now) also fills up with people saying the got their check. Neither of these has happened. I find it suspicious that the amount you claim to have gotten is the same as the marcos v wells fargo settlement whereas comments below suggest this settlement is paying $24 or $42 (not sure who to believe) and multiple people have stated that checks will be mailed on May 5th. Not saying you’re deceiving us but I’m retaining a healthy skepticism.

            Website says May 5th. Checks received and posted for May 7th from Florida would be correct considering Georgia is closer to Florida.

          The Markos v Wells Fargo was for robo calls on mortgage loans. The check you received was for this class action, the checks people are receiving for this class action are for 18.55. This thread is for the class action Cross v Wells Fargo which is also a robo call class action for overdraft text or calls. So you are posting on the wrong thread as Joe stated.

      Not sure what you’re asking. Did you file a claim before the deadline (January 16, 2017)? If yes, be patient and you’ll likely receive a check in 2 weeks. If you did not file a claim before the deadline passed then there is nothing you can do to be included in this settlement.

      May 11. I figure this because the effective date was 3/13/17, the settlement is to be funded 20 business days from that date (04/11/17) and distribution to valid claimants 30 days later.
