Vortens toilet owners have agreed to a class action settlement, ending allegations that manufacturer Porcelana Corona de México sold tanks that could spontaneously crack.
Class Members include those who purchased Model #3464 or #3412 Vortens brand toilet tanks between Jan. 1, 2011 and Dec. 31, 2011.
According to the Vortens toilet tank class action lawsuit, improper processes were used to manufacture the toilet tanks. In addition, the manufacturers reportedly failed to implement proper quality control.
The plaintiffs alleged that the manufacturers were aware of the issue, but failed to warn consumers — instead, consumers would have to find out the hard way, after their toilet tank cracked and leaked water, potentially leading to additional property damage.
The Vortens toilet class action claimed the plaintiffs suffered extensive damage to their property and personal items after their Vortens toilet tanks cracked. In addition, they and other consumers incurred cleaning costs.
The maker of the Vortens toilet tanks continues to deny any wrongdoing, but has agreed to award Class Members payment for the replacement of the tank as well as for damages caused by cracked tanks.
Class Members with proof can claim up to $300 per tank if they replaced or are going to replace their Vortens toilet tank. Those without proof can claim $150 per tank.
In addition, Class Members whose Vortens toilet tank model #3412 or #3464 cracked and caused damage can claim reimbursement of up to $4,000 if they provide repair receipts.
The deadline to object to the class action settlement is July 15, 2019. Class Members who wish to exclude themselves have until July 1, 2019.
Who’s Eligible
Class Members include anyone who “owns or owned a residence or other structure in the United States containing one or more Affected Tank. This includes any person or entity that suffered property damage and/or paid to repair property damage caused by the failure of an Affected Tank.”
Affected tanks include those stamped with model #3464 or #3412 with a manufacturing date between Jan. 1, 2011 and Dec. 31, 2011.
The model number and manufacturing date can be found on the inside of the tank.
Potential Award
Up to $300 per tank and up to $4,000 in property damage reimbursement.
Proof of Purchase
A minimum of proof of ownership of a Vortens toilet tank must be provided. Property damage claims must be supported by proof, including receipts, of the damage.

If you are a Texas owner of a Vortens Brand Toilet Tank manufactured between January 1, 2007 and December 31, 2010, click here to file a claim.
