Volaris has agreed to pay $3.2 million to resolve claims that airline customers had their calls recorded without their consent.
Individuals who, while located in California, called one or more of Volaris’ toll free telephone numbers between June 21, 2016 and June 23, 2017, spoke to a representative, and had their call recorded.
Plaintiff Malina Kindt filed her class action lawsuit against Concesionaria Vuela Compañía de Aviación, S.A.P.I. de C.V. and Controladora Vuela Compañía de Aviación, two companies known together as “Volaris.” Volaris is a low cost airline based out of Mexico.
The plaintiff claims that Volaris recorded consumer calls without consent after calling customers about the purchase of airline tickets. According to the call recording class action lawsuit, the company violated California call recording laws.
California is a state with extensive privacy laws that protect citizens from a number of violations. Some laws protect against violation of privacy through technological means, including the recording of calls without consent. Under these call recording laws, California consumers can take legal action if they believe that their rights were violated.
Volaris has agreed to pay $3.2 million to resolve the claims against them, although they do not admit any wrongdoing.
A website was first established in early May 2019 in order to provide information to consumers until claims were first accepted on May 28, 2019.
Class Members will be able to collect around $22.66 per call under the settlement. This amount is only an estimate and may be more or less depending on a variety of factors.
If Class Members wish to receive payment from the settlement, they need to file a valid Claim Form by July 27, 2019.
The deadline for exclusion and objection is July 27, 2019. The final approval hearing is scheduled for Sept. 19, 2019.

The aeromexico settlement had an expected payout of $50 per call and it ended up being a few dollars less than that, so there’s a chance that this could be $22 per call. I wish that they’d update the website, which is down at the moment. If it’s not updated with a mailing date by the end of the month then I will call the lawyer’s office in the beginning of february

So I got an email back saying checks will be mailed January 2020 and dollar amount not determine.
I’m the other Maria here lol. I’ll go by Maria L going forward. Did you e-mail the claims administrator or the lawyer? The lawyer always has the latest information, and probably does know how much each call will be. They have to because they sent out W-9 forms to people who will get over $600. In the future, if you have questions, google “Keller grover san Francisco” so that you can reach out to Eric Grover, the class attorney. He replies to e-mails right away and will talk to you if he’s in the office.

Hi.How much are the checks for.I haven’t received anything.
The checks will be different amounts because they are paying per call. I don’t know how much each call is paying but you can email the class attorney and ask. He will tell you how many calls you have. They still haven’t paid out yet but according to the website, the earliest date will be sometime in January 2020 because that’s when volaris will pay the lawsuit. If they pay earlier than that then the checks will be sent out sooner.

Does anyone have an update?
One of my friends said she got a w-9 yesterday so i came back to the comments. We looked through the Aeromexico claims comments (same attorney and claims administrator) and it looks like people got checks about 2 months after w-9’s were sent. I wonder if the claims administrator sent these now because they want to send payments as soon as they get the money, or if the money is already there. The website hasn’t been updated in a few months so hopefully the info is put up soon. It seems like the attorney responds to emails so I’ll ask my friend with the w-9 to reach out for more info
No appeals were filed so we will get paid in January. That seemed like a long time but I looked at the poster court documents and it says that volaris has until December to transfer the funds to the claims administrator
Might be sooner than that as I just got my W-9 to complete and return today
I didn’t receive a letter in the mail in regarding Volaris. I called them during this time.
