A website has been established regarding a $3.2 million settlement resolving claims that Volaris recorded customer calls about the purchase of airline tickets in violation of California law.
According to the Volaris class action website, claims will start being accepted on May 28, 2019.
The settlement will benefit individuals who, while residing or located in California, placed a call to the toll free numbers of Concesionaria Vuela Compañía de Aviación, S.A.P.I. de C.V. and Controladora Vuela Compañía de Aviación, S.A.B. de C.V. between June 21, 2016 and June 23, 2017.
Together, Concesionaria Vuela Compañía de Aviación, S.A.P.I. de C.V. and Controladora Vuela Compañía de Aviación are known as “Volaris,” which is a foreign airline.
Plaintiff Malina Kindt filed her class action lawsuit against Volaris in June 2017, claiming that the company recorded calls without consent. Kindt argued that these alleged recordings violated California law.
California has strict privacy laws that protect against numerous violations, including the recording of phone calls without consent. These laws allow consumers to take legal action against offending companies and seek compensation for any violations of privacy.
In the years following Kindt’s class action, there were numerous attempts to dismiss the suit, motions to appeal court decisions, and other court actions.
If Class Members file a valid claim, they may be able to collect payment. The current estimated payment per call is $22.66, but the set limit is as high as $5,000 per call. The deadline for filing a valid claim is July 27, 2019.
The deadline for exclusion and objection is July 27, 2019. The final approval hearing is scheduled for Sept. 19, 2019.
