Vital Nutrients settlement

A settlement has been reached in a class action lawsuit alleging RHG & Company d/b/a Vital Nutrients violated California law by selling products labeled as being “Made in USA” even though one or more components of the products were sourced from outside the United States.

If you purchased a Vital Nutrients product in the United States between Aug. 1, 2012 and Feb. 27, 2017, and the product was represented as being “Made in USA,” you may be entitled to a cash payment from the class action settlement.

Plaintiff Heather Maxin filed the Vital Nutrients class action lawsuit in October 2016. She says she purchased one of Vital Nutrients’ Vitamin D3 products that was represented as being “Made in USA”; however, she allegedly later learned that the products are wholly and/or substantially made with components that are manufactured, sourced and/or grown outside of the United States.

According to the Vital Nutrients class action lawsuit, the Vital Nutrients products contain “Made in USA” representations on the products themselves and on the company’s website. Maxin says she would not have purchased the Vitamin D3 product if she had known it was not actually “Made in the USA.”

Vital Nutrients stands by its “Made in USA” labeling and denies that it did anything wrong. However, the company has agreed to settle the class action lawsuit to avoid the burden and expense of continued litigation.

Under the terms of the proposed class action settlement, Vital Nutrients will pay $900,000 to provide cash awards to Class Members and to pay the administration costs, attorneys’ fees, incentive awards and other settlement costs.

Class Members who would like to exclude themselves from or object to the Vital Nutrients settlement must do so no later than May 30, 2017.

Who’s Eligible

Class Members of the Vital Nutrients settlement include anyone who purchased any Vital Nutrients product in the United States between Aug. 1, 2012 and Feb. 27, 2017 that contained an unqualified “Made in USA” label, or were otherwise represented as having been made in the United States.

Potential Award

$6 per product, up to a maximum of $150.

Class Members who submit proof of purchase may claim up to $150 from the Vital Nutrients settlement. Class Members without proof of purchase can claim up to $30.

The actual amount each claimant receives may be reduced on a pro rata basis depending on the total amount of valid claims filed.

Proof of Purchase

None required. However, Class Members who do not submit proof of purchase can only claim up to five products. Class Members who submit proof of purchase may claim up to 25 products per person.

NOTE: Class Members must provide the product name, quantity purchased, date of purchase and the city and state in which they made the purchase, and certify under the penalty of perjury that the information provided in the Claim Form is true and correct to the best of their knowledge.

    The settlement agreement states checks have to be mailed within 30 days of the final approval date.

    I took this vitamins for years filed a claim and no check yet. The claim was approved over a month ago, sometimes I hate to say but they want all the money for themselves,

    I submitted my claim on 12-08-17, and now I have to resubmit one again. The link does not work. I should start a class action suit against this. As this is all ready unfair to the people that have paid high dollars for those vitamins. How can we get this issue resolved?

    so its been 30 days since the final hearing… but the claim form deadline is later? I’m so confused. So basically we arent getting paid until a month or so AFTER 11/27?? ridiculous.

    I believe this ENTIRE SITE is for attorneys to claim victims, and use said victims as numbers to stake “their” claim as representation benefactors..when in fact..without the victim..the attorneys have mere case NUMBERS instead of case claims!!! WE THE PEOPLE…spent our paychecks on products…and WE THE PEOPLE … will give roughly 6 to 8 attorneys a multi million dollar paycheck on BEHALF of “THE PEOPLE.” FYI…THE PEOPLE…will divide $12 between the lot, revieving 12 cents PER PRODUCT!! Kudos to the brilliant minds who allowed “class action claims” to insult those who bought, used, and got taken by products that lied, and led group defenders to add insult at our very own misery!! Well played!

      This suit is not questioning the quality of the product only the claim that it was “made in the USA”. I know the lawyers get a huge amount of money but they work on these cases for years and risk getting nothing for that work if there is no settlement. And if there wasn’t the potential for a large payday for the lawyers none of these class action cases would happen and we would never get anything. The system is not perfect, absolutely not. But at least sometimes we can hold these huge corporations accountable for their actions.
