Settlement checks have been mailed from a Neptune Society telemarketing class action settlement as well as a Vital Nutrients “Made in the U.S.A.” class action settlement.

Top Class Actions viewers are reportedly receiving checks from the Neptune Society worth as much as $129.85 and from Vital Nutrients worth as much as $9.90.

Neptune Society Telemarketing Class Action Settlement

In May 2016, plaintiff Linda Allard filed a class action lawsuit claiming that she received telemarketing calls from SCI Direct Inc., doing business as Neptune Society, a cremation services organization.

Allard alleges that the calls she received violated the Telephone Consumer Protection Act (TCPA), which protects consumers from unwanted telemarketing calls, text messages, and faxes.

Allegedly, the company violated the TCPA by sending calls using prerecorded messages, and because they had contacted individuals who had not given prior consent to be contacted by the company.

Later in the litigation process, Allard amended her complaint to allege that Neptune Society further violated the TCPA by failing to maintain a written do not call policy, and failing to train employees to not call individuals listed on an internal do not call list.

Per the Neptune Society class action settlement, SCI Direct created a $15 million settlement fund from which affected individuals received funds to compensate for TCPA violations and to cover legal fees.

The deadline to file a claim for the Neptune Society TCPA class action settlement was Feb. 13, 2018.

The Neptune Society class action lawsuit plaintiffs were represented by Jeremy Glapion of the Glapion Law Firm LLC.

The Neptune Society TCPA Class Action Lawsuit is Allard and Strache v. SCI Direct Inc., dba Neptune Society, Case No. 1:17-cv-04692, in the U.S. District Court for the Northern District of Illinois.

Vital Nutrients ‘Made in USA’ Class Action Settlement

In October 2016, plaintiff Heather Maxin filed a class action lawsuit alleging that Vital Nutrients’ Vitamin D3 products are not entirely “Made in USA,” as advertised. She claims that at least a substantial part, if not all of the components are sourced and/or grown outside of the United States.

Maxin alleges that Vital Nutrients falsely advertised its product and intentionally misled consumers. She claims that she and many other consumers who purchased the Vitamin D3 product would not have purchased the product had they known it was not made in the USA, or would not have paid as much as they did for it.

Though Vital Nutrients continues to deny any wrongdoing on its part, the company agreed to settle the class action lawsuit for $900,000 to avoid the expense and burden of continuing to litigate the claims.

The deadline to file a claim for the Vital Nutrients ‘Made in USA’ class action settlement was Dec. 26, 2017.

    Sent a letter via USPS almost a month ago on the status of my Neptune Society submitted claim. I have not received a response as of this date. Its negligent for an Administrator not respond to inquiries, at least informing a claimant on status.
