Details on how to file a claim for the $23 million Vioxx class action settlement are now available. If you purchased the prescription painkiller Vioxx before October 1, 2004, you may be eligible to claim up to $50 cash or reimbursement of the actual out-of-pocket costs you paid for Vioxx, up to $75.
The Vioxx settlement resolves multiple class action lawsuits (consolidated as In re: Vioxx Products Liability Litigation) that allege Merck Sharp & Dohme Corp. falsely advertised Vioxx as having greater benefits than less expensive generic NSAIDs like ibuprofen or naproxen, when no such benefits had been established. Plaintiffs also claim that the marketing of Vioxx was inconsistent with its FDA-approved labels. As a result, consumers allegedly paid more for Vioxx than they otherwise would have.
Merck denies the allegations but agreed to establish a $23 million class action lawsuit settlement fund to resolve the litigation. The Court preliminarily approved the Vioxx class action settlement on August 2, 2013. A Final Fairness Hearing is scheduled for December 13, 2013.
Who’s Eligible
Class Members of the Vioxx settlement include all consumers who purchased Vioxx for personal or family use before October 1, 2004.
The class action settlement does not include consumers who purchased Vioxx before this date while living in Missouri. These Missouri consumers were already awarded a class action settlement, which has an October 7 Claim Form deadline. [See “Missouri Vioxx Class Action Settlement.”]

Proof of Purchase
The only way to receive a cash award of up to $50 or $75 from the Vioxx class action settlement is to submit a valid Claim Form and the required supporting documentation no later than May 6, 2014. Supporting documents include either proof of payment, proof of prescription or documentation of a post-withdrawal medical consultation.

Is it too late to get some of the sttlement
vioxx gave me a heart attack , is there a seperate suit for hospitalization?
I was given Vioxx that had a negative affect and due to complication spent a Night and half a day , in ICU.

I am getting the run around…:(. I was told to email back today so I did this morning no reply. They are doing extra processing on my check, they have already told me the dollar amount….guess they are making some interest on the money on people with checks over 500.00.
