A $215 million class action settlement has been reached to resolve sexual assault claims against former University of Southern California gynecologist George Tyndall.

The settlement benefits women who were seen by Tyndall at the USC Student Health Center between Aug. 14, 1989 and June 21, 2016, for which one or more of the following apply:

  • Were seen for women’s health issues (any issue relating to breast, vaginal, urinary tract, bowel, gynecological, or sexual health)
  • Treatment included a breast or genital examination
  • Treatment included photographs or videos being taken of her unclothed or partially clothed body

USC and former USC gynecologist George Tyndall have faced legal action due to allegations that Tyndall repeatedly sexually assaulted patients.

According to sexual assault survivors, USC covered up the abuse despite complaints from students and medical staff at the university’s Student Health Center.

Tyndall reportedly touched patients inappropriately during exams, took inappropriate pictures and videos of unclothed patients, and made lewd comments to patients.

Survivors of Tyndall’s alleged abuse claims that the disgraced gynecologist used his position within the health center to routinely take advantage of young women who may not have known exactly what an actual, professional gynecological exam should be like.

Both USC and Tyndall have agreed to settle the sexual assault claims. The settlement was announced by USC Interim President Wanda M. Austin in October 2018.

Austin called the settlement a “fair and respectful resolution” and noted that “sweeping changes” had been made across the university to help prevent misconduct in the future.

All Class Members are able to collect a minimum Tier 1 payment of $2,500. If Class Members are willing to share more about their experiences through writing or through an interview, they may be able to collect between $7,500 and $250,000 in Tier 2 and Tier 3 payments.

Claims to the settlement for Tier 2 and Tier 3 payments will be reviewed by a three member panel that includes a Special Master appointed by the court, a licensed OB/GYN, and a forensic psychologist.

A Statement of Class Membership Form needs to be submitted for Tier 1 payment and a more detailed Claim Form needs to be submitted for Tier 2 and 3 payments. These documents need to be submitted by Nov. 8, 2019.

The deadline for exclusion is Nov. 7, 2019. The deadline for objection is Oct. 9, 2019. The final approval hearing is scheduled for Jan. 6, 2020.

  1. Sexually Abused says:

It’s our money and know theses assholes wanna hold our money so they can keep it all. But I hired me a Attorney to do the work for me and they will giving me more when he’s done with them

  2. Patrina says:

Were the checks actually mailed? Cause I haven’t seen anyone post that they received one yet?

    1. Echo Juliet says:

I’m not sure how to post a general comment so I’m replying to yours, I wanted people to know the Tier One checks were mailed and I received mine a few days ago. Unfortunately my stupid bank, Chase, is refusing to honor the check and wouldn’t tell me why until I spent about four hours on hold trying to reach some mysterious special department; well this morning I finally got through to somebody from this elusive department and she told me they’d received “an alert from the issuing bank” that the check was going to bounce, and when I protested (loudly) she dug into it a little further and reported they’ve already seen some of the checks bounce, although to be fair she also told me some checks have posted normally. So I called the number listed above and spoke to a very nice person who took my information and promised to call me in two days after she’d escalated my concern to the correct team of people. So that’s my story today, guys, I hope everyone else has a better experience. Considering the current crisis, as a small business owner that money would’ve been literally life-changing for me right now…

    2. Joyce says:

have anyone received their letter yet?

      1. Ann Petricca says:

No! I keep asking for them to send it or give me an explanation. I am also being interviewed for tier 3. How am I deficient in tier one now ok for 3

  3. Mona Lisa says:

Chadwick, I don’t what your intention is…why you wasted time typing/sending a thoughtless, useless and unintelligible message. It appears as if people with low emotional intelligence do not understand the emotions or impact of tragic incidents or distress of others and want to speak for or about them. You seem to experience little empathy for other people–simply do not get what others are feeling or have experienced. Nonetheless, I wish that you won’t ever have to be placed in a situation that causes you pain or distress as incidents others experienced with Dr. Tyndall.

  4. Ashley McMasters says:

I checked my status online and it shows “mailed deficiency letter”. I emailed them too and they said they need to “verify my eligibility”.

Can some explain to me what this means? What is a deficiency letter? Are they requesting for my social security number or submit a picture of my driver license?

Never in the history of my life have I ever had medical liens or collections after me. I don’t owe any bills… Im 100% debt free. So why would they need this?

    1. Kailey says:

This has nothing to do with bill or collections it means they want to know more about you to verify if you were affected……..

      1. Joyce says:

if anyone received a letter yet please share we are curious to know what info they want from us that they don’t know them selves, this is why I say they are only trying to find away to keep all the money for themselves read the FAQ again

        1. Geannie2018 says:

My status still shows pending for some reason

          1. CIARA T MACK says:

How do you check your status

        2. Geannie says:

Nope I haven’t and it still shows pending for me

        3. Ann Petricca says:

No! I keep asking for them to send it or give me an explanation. I am also being interviewed for tier 3. How am I deficient in tier one now ok for 3

        4. Dane says:

Something coming in informed delivery, it looks like a letter

  5. Lisa says:

Checks were mailed 04/06/2020. You can check your claim status on their website by entering your email address and password. Most should have their checks by Saturday! Only those with VALID claims!!!

    1. Lisa says:

@Denise….It shoes they were mailed out. Look on their website. If your claim was VALID, then you’ll get a check!

      1. Lisa says:

        *SHOWS

      2. Rebecca says:

We now know that the tier 1 payments have been sent out……

But does your say Approved or does it still say pending ?

        Anyone ?

        1. Lisa says:

Many still says “Pending.” However, the site is updating those statuses. But be warned….a lot of those that says “Pending” means they are going to send you out a letter requesting more information.

    2. question says:

did anyone status change today? 4/7/2020

      1. Rebecca a says:

        Nope , still says pending

        1. Mona Lisa says:

          Rebecca,

Checks will still be sent out. They just begin disbursement yesterday for all claimants that have no medical liens. Administration is still checking, and as soon as it has been confirmed that there are no liens, checks will be mailed. Some claimants have been cleared already that’s why their eligibility status is approved instead of pending. The following is the message I received after an inquiry:

Tier 1 determinations and Settlement payments will commence on April 6, 2020. Statuses will be updated in the online claims portal thereafter.

However, we have not resolved potential lien issues on your claim. Under Section 5.10 of the Second Amended Settlement Agreement, we have been identifying and resolving potential liens owed for medical treatment on behalf of Settlement Class Members and determining whether there is a potential repayment obligation for medical treatment. At this time, not all governmental lien obligations have been resolved on your claim and we are working with Medicare and a handful of remaining state Medicaid offices to finalize any potential lien obligations. Your Tier 1 Settlement payment will be released once it is confirmed lien(s) have been waived or satisfied.

          Sincerely,
          Settlement Administrator

        Nopestill shows pending

    3. Joyce says:

just checked my status I am receiving a deficiency letter have anyone else receive this? I wonder what could they want me to give from 1989

      1. MEAGAN says:

A lot of people are going to receive those. What the heck they are going to need from 1987 is ridiculous! I just think this is another lawsuit where the Attorneys are going to be the WINNERS!

      2. Dane says:

        Mine said the same thing.

  6. CORAL says:

WHAT PAPER HAD TO BE NOTERIZED?//

    1. question says:

have anyone else receive email I am still waiting for them to respond back to me

  7. Katarina says:

Did anyone have to get a form notorized? If so did you file level 2 or 3?

  8. Mona Lisa says:

I called today and Tier 1 payments are still going out on April 6, 2020.

    1. question says:

sally are you saying that your status has changed from pending? mine have not.

    2. Mona Lisa says:

Status will remain pending until medical liens have been checked and satisfied. If there are no liens, check will be mailed.

      1. joyce says:

Mona, if you check the key dates everything with green check means complete. I don’t think they are going to mail a few at a time I am thinking tomorrow if it turns green than that mean checks are on the way I hope I am right

        1. Mona Lisa says:

        2. Mona Lisa says:

Joyce, I received an email message after I made an inquiry and I was told that my status is still in the pending stage until all medical liens were satisfied if there were any. I don’t have any, but I guess the administration there checks for med liens before sending out claimants checks.
