Current and former residents of an area in Peshtigo, Wisconsin, may be eligible to benefit from a $17.5 million Tyco Fire Products settlement if a private well provided their drinking water.

The Class includes anyone who, between Jan. 1, 1965, and Dec. 31, 2020, resided in or owned a property with a private well drinking-water source within the area bounded on the north by University Drive, on the south by Heath Lane, on the west by Roosevelt Road, and on the east by the Bay of Green Bay, all in the town of Peshtigo, Wisconsin, for at least one year.

The Tyco Fire Products settlement is part of a multidistrict litigation accusing Tyco, Chemguard Inc., and ChemDesign Inc. of contaminating private wells with per- and polyfluoroalkyl substances (PFAS) through their firefighting foam.

PFAS are manmade chemicals containing carbon, fluorine, and additional chemicals.

Testing of the foam at the Ansul Fire Technology Center allegedly began around 1965, which is why the Class Period begins Jan. 1 of that year.

Peshtigo lacks a municipal water system, and as such, many properties’ drinking water is provided via wells.

Peshtigo Tyco Fire Products Settlement Benefits

The Tyco Fire Products settlement provides Class Members with payments to resolve claims for damages due to exposure to PFAS, even if they do not have proof of an injury, as well as payments to resolve claims for personal injuries.

Class Members may file up to three claims: a property ownership Claim, an exposure claim, and a personal injury claim.

The amount each Class Member filing a property ownership or exposure claim will receive will depend on whether they own the property now or owned it in the past and on the amount of PFAS in the property’s well.

Payments for exposure will range from $1,000 to $6,500, while payments for property ownership claims range from $4,000 to $65,000.

A chart on the settlement website can help Class Members estimate what their payment would be.

Any amount to be paid for personal injury claims, which are separate from Class claims, will depend on the number of such claims that are made and the types of injuries suffered and cannot be determined until all claims have been received.

However, it is estimated each person who files an eligible personal injury claim will receive a minimum of $50,000.

A fairness hearing on the Tyco Fire Products settlement is set for May 24, 2021.

The deadlines for Class Members to opt out of or object to the settlement have passed.

The claim form deadline for property and exposure damages is Oct. 6, 2021.

Who’s Eligible

Anyone who, between Jan. 1, 1965, and Dec. 31, 2020, resided in or owned a property with a private well drinking-water source within the area bounded on the north by University Drive, on the south by Heath Lane, on the west by Roosevelt Road, and on the east by the Bay of Green Bay, all in the town of Peshtigo, Wisconsin, for at least one year.

Potential Award

Up to $65,000.

Proof of Purchase
  • Proof of residency in the Class Area at any point between Jan. 1, 1965, and Dec. 31, 2020, from at least one of the following: state-issued identification with address (such as a driver’s license), utility bills, other types of bills or bank statements, or mail addressed to the Class Member at the affected property’s address.
  • Any documents, if available, demonstrating PFAS testing results on the relevant private well during the Class Period.

    Is there an email address or number to call? I can not find this information just to get the status on my claim. They needed more information from me, I sent it in and never received anything more. Haven’t received a check yet…so, I’m curious on status. Any information is appreciated.

      I have not received payment yet. But then again, I was approved but was missing information so I had to send in more information. I think this is what’s holding up people from receiving their payments.

      I’m away from mailing address. I see through USPS website that I have mail from the Administration. Hopefully its my check. How did your check look? The envelope I see looks like papers and not and actual check. Any info is appreciated

        I receive my letter from them monday i was denied it stated my home was out side the eligible zone limit I was hoping it was a check but it wasn’t i am glad to have it behind me now good luck to the ones that is still waiting.

    i just got my check for $1,000… i was a former resident..

    in the court documents they said that the payments were going to be much HIGHER since less people filed for this lawsuit…. $1,000 was the original award, so i should have received MORE since the payments were supposed to be higher..

    i bet the lawyers and settlement admin got those payments instead of us..

      They said some claimants may receive more than one payment so, you never know…you could get another one. However, you right they should have been much higher than $1,000 for sure.

      If you are thinking these lawyers are reviewing deficiencies claims as they want you to think they are not they have done all they are going to do,it is called letting the money set to get interest which mean even more money in their pockets not our you will see what I am saying when ever they start to pay out Good Luck everyone

    It is now May 20 and still no checks!!! They said that checks will be going out in April or May.. May is almost over!

    Someone needs to contact them and see when they will send checks.. Are the settlement admins too busy having a kickback party or something. JUST SEND THE CHECKS ALREADY

        No there isn’t but the lawyer who is the admin is listed. A simple Google search will give you his or his firms phone number. And class counsel lawyers names are also listed. You can find email addressed and phone numbers for them as well simply by searching the Internet. I emailed the administrator and never received a response so I emailed one of the lawyers for the class counsel. HE forwarded my email to him to the administrator who then had the project manager contact me. This person probably did speak to someone.

    It doesn’t look like many will get a payment from this settlement due to a lot of denials and deficiencies and fraudsters.

    On February 28, 2022, the
    Settlement Administrator sent 192 letters to Class Members informing them that their claim was deemed complete and eligible for Class Benefits. On the same date, however, the Administrator sent 922 letters notifying individuals of the deficiencies contained in their claim submission. In the Settlement Administrator’s experience, it is possible that a substantial percentage of these deficiencies are due to individuals who are purposefully submitting a false claim to see if it would be accepted by the Administrator.
    Those with clear fraud (such as those on a known “fraudster” database, or those where supporting documents show clear alterations) will be denied automatically.
    Epiq spent considerable time checking property addresses for eligibility,
    reviewing supporting documentation, and reviewing the content of the claim for inconsistencies and potential fraud.
    The Settlement Administrator cannot determine any Claimant’s final
    class settlement amount until all claims are fully reviewed. As in all settlements, scrutiny and program integrity are crucial; in this matter they are even more important, because the more diligence the Settlement Administrator brings to bear in vetting claims, the greater the ultimate payments will be to truly eligible Class Members. In fact, the Settlement Administrator believes that a likely benefit arising from this additional time spent in finalizing claim review is that the actual payment amounts to Class Members ultimately deemed eligible will be larger than originally forecast.

    About time so looks like the claimants that are “Truly” eligible will end up with a much bigger payout after all the denied, deficiencies and fraudsters eliminated.

    Any updates? It is now May 9th and still no checks. Someone contact them and see if they have any updates. The settlement admin is trying to squeeze every day to get more interest on this settlement… PAY UP ALREADY!!!

      I called the number that they called me from when I was told I was eligible. It went to voicemail and said the mailbox was full!

      Or are you still waiting on someone to do it for you?
      I’m curious if there’s ANY update at all?
      I know they said end of April, beginning of May… but we’re almost halfway into May and haven’t seen a dime.
