Update:

  • Top Class Actions readers reported this settlement paying out $717.23 as of Aug. 4, 2023.
  • Congratulations to everyone who filed a claim and got paid!

Current and former residents of an area in Peshtigo, Wisconsin, may be eligible to benefit from a $17.5 million Tyco Fire Products settlement if a private well provided their drinking water.

The Class includes anyone who, between Jan. 1, 1965, and Dec. 31, 2020, resided in or owned a property with a private well drinking-water source within the area bounded on the north by University Drive, on the south by Heath Lane, on the west by Roosevelt Road, and on the east by the Bay of Green Bay, all in the town of Peshtigo, Wisconsin, for at least one year.

The Tyco Fire Products settlement is part of a multidistrict litigation accusing Tyco, Chemguard Inc., and ChemDesign Inc. of contaminating private wells with per- and polyfluoroalkyl substances (PFAS) through their firefighting foam.

PFAS are manmade chemicals containing carbon, fluorine, and additional chemicals.

Testing of the foam at the Ansul Fire Technology Center allegedly began around 1965, which is why the Class Period begins Jan. 1 of that year.

Peshtigo lacks a municipal water system, and as such, many properties’ drinking water is provided via wells.

Peshtigo Tyco Fire Products Settlement Benefits

The Tyco Fire Products settlement provides Class Members with payments to resolve claims for damages due to exposure to PFAS, even if they do not have proof of an injury, as well as payments to resolve claims for personal injuries.

Class Members may file up to three claims: a property ownership Claim, an exposure claim, and a personal injury claim.

The amount each Class Member filing a property ownership or exposure claim will receive will depend on whether they own the property now or owned it in the past and on the amount of PFAS in the property’s well.

Payments for exposure will range from $1,000 to $6,500, while payments for property ownership claims range from $4,000 to $65,000.

A chart on the settlement website can help Class Members estimate what their payment would be.

Any amount to be paid for personal injury claims, which are separate from Class claims, will depend on the number of such claims that are made and the types of injuries suffered and cannot be determined until all claims have been received.

However, it is estimated each person who files an eligible personal injury claim will receive a minimum of $50,000.

A fairness hearing on the Tyco Fire Products settlement is set for May 24, 2021.

The deadlines for Class Members to opt out of or object to the settlement have passed.

The claim form deadline for property and exposure damages is Oct. 6, 2021.

Could someone tell me who the class admin handling this is? There was a letter in my informed delivery several days ago and it never arrived, so hoping I can send class admin an email (I do not usually have time during the week to call during business hours) asking to resend whatever the letter is. Thanks a lot

    1. TIm Tam says:

The administrator info is not available, but you can contact the class counsel. Go to the website for the settlement, then “Contact Us” to find their contact info.

  4. Lee says:

Received letter that my claimed qualified and payment will be disbursed in April.

  5. R R says:

    From the website:

As communicated in the last update, the majority of claims received by the Administrator were submitted with some form of deficiency. These deficiencies are complex and require in-depth document analysis. The Administrator is making good progress, but the review process is taking longer than initially anticipated.
Notices of claim status (e.g., whether a claim is Approved, Denied, or Deficient) will be sent beginning in late February and will continue (at least) through March. Class Members will have 30 days to cure deficiencies, so payments may not begin until April 2022.
We ask for your continued patience as we work through this process. We know it can be frustrating when timelines extend beyond the dates originally forecasted. Please understand the Administrator is required by the Court to make sure that only valid claims receive appropriate settlement compensation. We cannot determine any Class Member’s settlement amount until all claims are fully reviewed, because each Class Member’s final amount depends on how many Class Members qualify for each type of claim.
