Case Name
Dean Mahan, et al. v. Trex Co. Inc., Case No. 09-cv-00670, in the U.S. District Court for the Northern District of California
Case Summary
The Trex decking settlement resolves a 2009 class action lawsuit (Mahan v. Trex Company Inc.) that alleges certain wood-plastic composite decking products sold by Trex were defective and susceptible to mold, mildew, fungus, or other spotting and discoloration. According to the product’s 25-year warranty, the decks would not suffer from material defects or damage from fungal decay, plaintiffs allege in the class action lawsuit.
Trex denies the allegations, insisting that the fungal damage is related to environmental factors that were not covered by the warranty, but has agreed to pay $8.25 million to resolve the litigation.
Final Hearing
12/13/2013

I to have a front deck with sun fading and lots of mold and just found out about the lawsuit first generation Trex lumber is crap the word never got out and they need to make it good
This is not a reasonable settlement. This company needs to fully replace. Is there another law firm handling more. If not all of you call my phone I’ll start setting up a group of us. I bought 8 years ago. I will sue the pants off of them. We are replacing our decking. This 150 and the attorney walks with thousands is a joke. My phone is 8104495574 Give your name when you bought the decking and we will work on doing a smaller suit and taking them to court for replacement. If you live in Michigan it would be best.
So much for lifetime warranty how did they get away with this cheap of a lawsuit. They told me in 2014 they lost my record, then they asked for a receipt. I sent a receipt and then they said we can’t read it. This is simple millions for harassment. :Kept stating we lost, then we found then we switched systems, then we can’t read not dark enough receipt, then then then.
I just found this class act lawsuit. We have purchases trex for our deck 10 years ago. Color fades and mold, dirt and alway staining. Product is false advertisement!!
I have this deck in a new house that the builder chose and 6 months after moving in had mold spots. I have to try to clean it three times a season and mold always returns. It is very difficult to clean and is entirely too much mantinence to keep up with. This is a defective product.
Wow — great that we heard all this manufacturer nonsense BEFORE possibly buying !! Now here’s my solution Jack ripoff arrogant vendor — N-O-T gonna buy your deficient product !! Plain old treated wood will be just fine, thank you !!
Ha-ha !!!!!
Trex correspondence is from p o box number. They will not give you address. I personally flew from midwest to Georgia Norcross area only to find nothing exist. Company opened p o box for this settlement hiring woman named Rani to reject every single claims. Everything reject reject reject… They will pay lawyers and rest will get nothing and will shut this site . Fly by night and disappear..
I ALSO RECIEVED THE DENAIL LETTER, I SUBMITTED ALL NECESSARY DOCUMENTATION. WHAT A PAIN. CLEANING THE DECK, SENDING A SAMPLE OF PRODUCT, VIDEO TAPING, ECT. ECT. IN WHICH ALL COST $$.
ALSO, SENT IN APPEAL LETTER. THAT OF COURSE DENIED AND STATED : DECISION FINAL.
NOT ONLY IS MY DECK FULL OF MOLD AND MILDEW, AND DISCOLORED. IT IS WARPING.
TREX IS JUNK
I too received the “denied” letter. I had not known about the class action before we replaced the deck and so had no pictures of the old deck with the yuck on it. I tried explaining that to them and also included the receipt for replacement that was dated well before I submitted the claim, but no luck.
It looks as if everyone that has a responsed has had the same problem with their deck and like me, received the response letter from the Trex folks that you didn’t meet THEIR requirements for any type of reimbursement. WHAT A LOAD OF CRAP! I say we get the word out in all our local stores that sell Trex and post flyers/letters of what CRAP TREX IS SELLING. Hit every web-site that offers the TREX product letting anyone interested in purchasing Trex products know first hand, one how the product molds, you clean and for a few weeks it looks good, but then the SAME MOLD IN THE EXACT SAME SPOT’s ARE RIGHT BACK. AND HOW TREX DOES NOT STAND BEHIND THEIR PRODUCT and last all the hoops we had to jump through to prove we purchased trex and that is molds, that we cleaned it to their specs…..etc. on and on. I think the Trex and the so-called lawyers that represented US(HA HA) are like the product they sell. A LOAD OF CRAP
If enough of us can work together and do this, maybe the word will get out and Trex can start feeling the effect.(8/18/14)
What if you missed the deadline (5/27/14) to file the claim are you out of luck and just have to deal with the horrible mold?
Please contact me if you hear of any avenues left for those of us that missed the 5/27/14 deadline. Thanks
I ripped up my old pressure treated deck for the “end of my days of staining and upkeep trex. What a mistake. After one week mildew and mold was all over it.I called for a rep to come and see it.I was told they don’t do that.I then was told to clean it with Olympic Deck cleaner. One cleaning didn’t help.I was then told you may have to clean it three times to get it clean. This is the maintenance free trex. Now they recommend putting Behr water based stain on it.Maintenance free huh. Then I was told I had to register the new deck with trex for a warranty on the product which no one ever mentioned before.Give me back my old pressure treated wood. What a rip off.
