Trex Decking class action settlement

Details on how to file a claim for the Trex decking class action settlement have arrived. If you own or owned a deck, railing, fence or other structure built with certain Trex products purchased between 2004 and 2013, you may be eligible to claim a cash award from the class action settlement.

Who’s Eligible

Class Members of the Trex class action settlement include anyone who owns or owned a structure built with wood-plastic materials sold under the following Trex trademarks between August 1, 2004 and August 27, 2013:

  • Accents Fire Defense®
  • Origins®
  • Brasilia®
  • Contours®
  • Profiles®
  • Traditional Railing®
  • Designer Series Railing®
  • Seclusions®
  • Surroundings®
Potential Award
  • Tier 1: One-time cash payment of $150.
  • Tier 2: (a) Reimbursement of the cost of purchasing cleaning product at a flat rate of $18; and (b) a non-transferable payment certificate entitling you to a cash reimbursement equal to 40% of the retail price you paid to purchase certain new Trex decking and Trex-brand fasteners (if you used these in your current Trex structure) to replace your existing Trex decking and Trex-brand fasteners.
  • Tier 3: (a) Reimbursement of the cost of purchasing cleaning product at a flat-rate of $18; and (b) either a (i) non-transferable payment certificate entitling you to a cash reimbursement equal to 50% of the retail price you paid to purchase certain new Trex decking and Trex-brand fasteners (if you used these in your current Trex structure) to replace your existing Trex decking and Trex-brand fasteners, if applicable, and a payment for labor reimbursement at the formula rate of $0.23 cents per linear foot of replacement decking, or (ii) a refund of 20% of the original purchase price of your current Trex product.

Case Summary

The Trex decking settlement resolves a 2009 class action lawsuit (Mahan v. Trex Company Inc.) that alleges certain wood-plastic composite decking products sold by Trex were defective and susceptible to mold, mildew, fungus, or other spotting and discoloration. According to the product’s 25-year warranty, the decks would not suffer from material defects or damage from fungal decay, plaintiffs allege in the class action lawsuit.

Trex denies the allegations, insisting that the fungal damage is related to environmental factors that were not covered by the warranty, but has agreed to pay $8.25 million to resolve the litigation.

    I to sent in all required documentation.Two months later I recieved the same “claim denied letter”.My deck is three years old and has faded from dark brown to gray.Mold covers the complete 24′ x 20′ deck.
    If a class action lawsuit is launchd in Canada I’ll be the first to sign up.

    My parents also rec’d a letter with their claim denied – all necessary documentation was sent and required paperwork filled out, including proof of home ownership, pictures, a piece of the decking, invoice of materials, contractors invoice for labor. Every requirement they requested. I’ve tried to call, I’ve sent an email – all leading to a dead end. Is there anything else that a homeowner can do? Can you begin another class action?

    Consumers are being ripped off with false advertisement (completely care free with no mold or mildew).

    I received a letter from Roni Ealy, Trex Claims Representative stating I did not send necessary documentation for the TREX claim. However, I did send documentation not only once but twice. In the last mailing I included the requested original piece of TREX material used on my deck and updated pictures. I have also had my deck professionally cleaned again and not only has it faded even more but the mold started back.

    I have tried to contact someone at 1-877-495-0068 but cannot reach a person to speak with.

    Received a letter from company today that our claim is rejected. Its printed common letter with our names and address typed on top signed by some woman named Roni. Seems like they sent over 2000 rejection letters that they don’t have to pay at all. We had sent receipts of purchased materials from Lowes. Two years ago Crayola company from Pa plant did same thing. Out of over 50,000 claims Crayola received they approved hardly 5 percent paying with some free crayons very few with monetary compensation. Companies are getting away with everything after court ruling nobody watches.

      I got the same kind of letter. It just say in general that “Failure to submit requested information to support the claim…”. But I am sure I did send all the documents/pictures/samples that they asked for!

      What a liar!!

    Hi i Have been calling trex decking for some time ad No one eer told us about a aclass action suit this is totally not right I am a customer and will never buy from these rip offs again after paying top dollar for a good product so we thought it was totally not worth it china made junk

    Am I reading this correct that tier 2 and 3 require you to replace your current Trex decking with new Trex decking if you are awarded compensation.

    I have two TREX decks, one 8 years old the other 7 years old. After two or three years I noticed appearance problems including mildew and now the older deck is getting brittle. The settlement options will not work for me as I no longer have receipts. And I do not believe it reimburses the customer anywhere near the proper amount.

    I agree to rip off part, Still have the decking and we are very disappointed, have been in touch with Trex directly when we noticed years ago and the hoops to go thru for reimbursement is ridiculous. Opt 2… Like we would ever purchase again??? Seriously, and love Opt. 3 for a deck finished for almost six years ago, we have three one inch pieces to send in for analysis, send one of the reps to our home I would love to show them the gross mildewed product they are selling innocent customers. What a waste of time and money. Not sure if we even want to send in for $150 refund. I would love to replace the decking but with how much we paid for it looks like that is not going to happen. The options are a waste of time. THANKS TREX for the inferior product.

    What if you had the affected product replaced? Can you still file a claim if you no longer have the discolored decking?
