T-Mobile and Asurion have agreed to pay $4.2 million in order to settle a class action lawsuit that alleged the companies sold cellphone insurance to customers without fully disclosing details of the policy in violation of California law.
According to the T-Mobile and Asurion class action lawsuit, the insurance policy allowed Asurion to fulfill claims with refurbished phones, phones of a different make or model and phones that are worth less than the cost of the deductible.
Lead plaintiff Wineesa Cole filed the T-Mobile cellphone insurance class action lawsuit after trying to file a claim through Asurion. Cole claims that she was told that by purchasing the insurance policy for $3.99 per month, all she would have to pay is a $35 deductible if her cellphone was lost or stolen.
However, the cell phone insurance class action lawsuit claimed that when Cole lost her phone the insurance company informed her that she would have to pay $110 deductible or her cellphone could be replaced with a refurbished phone that could be worth less than the deductible.
Lead plaintiff Wineesa Cole alleges that T-Mobile and Asurion should be found liable of violating California’s Unfair Competition Law.
T-Mobile and Asurion deny any wrongdoing but agreed to the terms of the cellphone insurance class action lawsuit settlement in order to avoid the cost of further litigation.

Any update yet? Soon it will almost be a year come February 2017.
It looks like the appeal was dismissed in November 2016, which is good news! Unfortunately, no update on when claims will be paid. Please keep checking Top Class Actions for updates. We will let our viewers know as soon as we learn that checks are in the mail!
I’m with AT&T. They have addition as well and it’s a rip off of a joke if you file a claim. And most of their employees have no customer service skills! They totally suck! I am so angry! I’m going to call an attorney tomorrow!
This class action is the exact reason why I left t-mobile.
Apple in the class action lawsuit of T-Mobile my name is Chris Davis where can I check the results
I filed a claim but not sure if it registered or was received , as I have not heard anything about it. Should or can I file another one. I was with T-Mobile/Asurion for many years and was charged insurance fees on both phones(mine and son) and did not want any. Tried to use insurance once and was told phone could not be fixed and cost was more than insurance would cover.

An appeal shouldn’t be more then 90 days…any update?
Mary, Appeals can take several months or even years to resolve. As of July, the T-Mobile/Asurion cell phone insurance class action settlement is still under appeal. Please keep checking Top Class Actions for updates. We will let our viewers know all appeals are resolved!
Any update ?
Unfortunately, the appeals are still ongoing.
There is at least one appeal by a guy who thinks the total payout based on the number of claims isnt enough. This lawsuit is not going to be paying for a while. The end result will probably force the class administrators to verify each claim form in order to rule out the fraudsters so that the final payout can be higher. The claims administrator was just going to pay anyone who filed.
When can we expect our settlement?
I just would like to know the payout amount and who if anyone has received a refund??
I would like to know tbe same thing!!! Whe is the payout??
I have a real problem with T-Mobile and Asurion. Next time purchase apple care! Much cheaper and less headaches!
