T-Mobile and Asurion have agreed to pay $4.2 million in order to settle a class action lawsuit that alleged the companies sold cellphone insurance to customers without fully disclosing details of the policy in violation of California law.
According to the T-Mobile and Asurion class action lawsuit, the insurance policy allowed Asurion to fulfill claims with refurbished phones, phones of a different make or model and phones that are worth less than the cost of the deductible.
Lead plaintiff Wineesa Cole filed the T-Mobile cellphone insurance class action lawsuit after trying to file a claim through Asurion. Cole claims that she was told that by purchasing the insurance policy for $3.99 per month, all she would have to pay is a $35 deductible if her cellphone was lost or stolen.
However, the cell phone insurance class action lawsuit claimed that when Cole lost her phone the insurance company informed her that she would have to pay $110 deductible or her cellphone could be replaced with a refurbished phone that could be worth less than the deductible.
Lead plaintiff Wineesa Cole alleges that T-Mobile and Asurion should be found liable of violating California’s Unfair Competition Law.
T-Mobile and Asurion deny any wrongdoing but agreed to the terms of the cellphone insurance class action lawsuit settlement in order to avoid the cost of further litigation.
UPDATE: The T-Mobile/Asurion cellphone insurance class action settlement is currently under appeal.  Claims will not be paid until all appeals are exhausted. We appreciate your ongoing patience. UPDATE 2: The appeals to the T-Mobile/Asurion cell phone insurance settlement were dismissed on November 15, 2016. Â TCA Viewers reported receiving settlement checks in April 2017.
Who’s Eligible
The T-Mobile class action settlement is open to all Class Members who while residing in the State of California purchased cellular telephone insurance from Asurion through T-Mobile between Aug. 1, 2003 and Apr. 2, 2008.
Potential Award
Varies.
Class Members who submit a valid Claim Form will receive an equal share of the $4.2 million T-Mobile cellphone insurance class action settlement. The actual amount each Class Member receives will depend on the number of valid Claim Forms submitted.
Proof of Purchase
N/A.
T-Mobile class action lawsuit settlement Class Members are not required to submit proof of purchase. However, in order to receive financial compensation they must submit a valid Claim Form no later than Feb. 26, 2016.

I would like to know how T-Mobile / Assuring can change the cost of a protection/insurance coverage plan in the middle of the phone/service agreement period. I.E. I purchased my phone about a year ago, I am still making pymt on it and haven’t paid it off yet, I received a notice in the mail stating that the monthly cost of my Asurion coverage will be going up as of March 1, 2016. They should have to honor the price I was given when I signed up for this phone all the way until the end, or at least until I decide to purchase a new phone, that would be a new contract.. The phone value is going down and yet they will be collecting more on it… doesn’t seem right to me.

I live in Denver Co and I have had to pay over $100 2-3 times during my time as T-mobile which I have had for over 12 yrs. They always give refurbished not new phones. Each time they did not have the same phone. I often wonder why these cell phones just stop working so you have to buy a new phone. If this ever comes around to ALL T-Mobile users.
This don’t apply to New York? Ive had Tmobile for 15 years and always paid the insurance and I know that was the company at the time. Ive had paperwork from the… how can New York get involved? I want answers!!
I have kept a T-mobil phone and the same thing was happening here In Wisconsin. If they did it there they did it everywhere. Whats with this?

IS GREAT SETTLEMENT I HAVE A T MOBILE FOR 4 YEARS NOW
T-Mobile does this in other states as well. I had to recently file an FCC, Attorney General, and BBB report for this exact reason. We live in Kansas. They placed insurance on my phone over a two year period when I never authorized it. We only authorized it on my spouses phone, since his is worth about $400. My phone was worth about $30 to replace, but they charged almost $60 a year for the insurance.
That happened to me here in Arkansas. Why is it that California residents only get compensated?!?
Because the laws are different in different states. California has some if the strongest consumer protection laws in the country

Users have switch from T mobile, how in the hell will anyone remember their old phone number, it should have been ask to enter ss# or last four digits. T-MOBILE SUCKS!!
