A settlement has been reached in a class action lawsuit alleging a price-fixing conspiracy in the pool products industry. Consumers who bought pool products in certain states between Jan. 1, 2008 and July 16, 2013 may be eligible for cash benefits from the class action settlement.
Pool products manufacturers Pentair Water Pool & Spa Inc., Hayward Industries Inc. and Zodiac Pool Systems Inc. were hit with a class action lawsuit alleging they conspired with distributor Pool Corporation to fix the prices of pool products, resulting in consumers paying artificially inflated prices for pool products between Jan. 1, 2008 and July 16, 2013.
According to the pool products class action lawsuit, the defendants used their market power to engage in unfair business practices and stifle competitors. This conduct allegedly resulted in higher prices, reduced output and reduced consumer choice for pool products.
The defendants deny the allegations but agreed to a settlement in order to avoid the risk and expense of continued litigation. Pentair has agreed to pay $600,000, Hayward has agreed to pay $1.5 million and Zodiac has agreed to pay $500,000 to settle the pool products class action lawsuit. The litigation is continuing against Pool Corporation.

Who’s Eligible
Class Members of the pool products settlement include individuals or entities in Arizona, California, Florida or Missouri which purchased pool products (not for resale) from a pool retailer, builder or service/maintenance company (or individual) in Arizona, California, Florida or Missouri at any time from Jan. 1, 2008 through July 16, 2013.
NOTE: In Missouri, only persons or entities that purchased pool products primarily for personal, family or household purposes are eligible.
The class action settlement defines “pool products” as “the equipment products, chemicals, parts or materials used for the construction, maintenance, repair, renovation or service of residential and (except in the state of Missouri) commercial swimming pools,” and includes products such as chemicals, cleaners, covers, diving boards, filters, heaters, pool liners, pool walls, pumps, rails, and white goods (the parts necessary to maintain pool equipment) manufactured by Hayward, Pentair or Zodiac and sold by Pool Corporation or any of its subsidiaries indirectly to end users.

Proof of Purchase
It is recommended that claimants attach at least one form of “verifying” information. This can include a receipt, the serial number of the equipment, a photograph of the pool product, a confirmation of the purchase provided by the pool supplier, warranty information and/or the owner’s manual for the product.

We are currently processing claims. When this process is complete, each claimant will be sent a Determination Letter to notify them if their claim was deemed eligible or if it was denied. For claims that were deemed to be eligible, the Determination Letter will also include the dollar amount that will be used to calculate their share of the Net Settlement Fund. We estimate that those Determination Letters will be sent at the end of the Summer of 2016. We estimate that Plaintiffs’ Counsel will motion the court to approve the distribution of funds in the Fall of 2016. If the motion is granted by the Court, we estimate that distribution checks will be mailed by the end of the year.
I listed 8 gallons of chlorine, stabilizers and a few other items I admited to purchasing only on two occasions to minimize paperwork and time. CLAIM DENIAL letter recieved today.
Location could have verified product was carried. And was a legit claim. Hard to take pictures of empty bottles returned and very old credit card receipts that don’t show items I clearly noted. Dont expect a check unless you have a community pool with a full time Secretary to do all the paperwork and search for itemized receipts that were saved for well over 5 years. This will be a very tuff suit to get even a bit of your money back from.
Emailing this week I was told that they are still going through claims and have not set a distribution date yet.
A lot of people just can’t afford keeping up a pool these days. They just fill them up with dirt and plant marigolds.

If anyone receives a settlement check can you please post that itwas received….I am just waiting and not sure if my claim was accepted. Does anyone know who to call?
They were big claims such as municipalities and community pools as well as the small residential claim, but the total did not exceed 2000. Also this is an anti trust price fixing case and we are only entitled to compensation of the fraction of pricing beyond reasonable price. I do not know what to expect. These chemicals and accessories are expensive at any rate.
Im surprised at the 2000 number as well. My husband had a service for over 30 yrs. Chemicals were the biggest expense.
Court docs have disbursements being ordered as of May 20th to the administrators. There was less than 2000 claims even filed and the filing deadline was Dec. 11, 2015. My email said after the hearing in May. I would say give them at least 30 days to disburse. Give or take a couple weeks.

You did know that very seldom do more than 1% of alleged class member file claims. The main reason is the fact that the notices are sent to the wrong parties. The parties who received the notice are not eligible to file a claim. For example, I got the notice. I have never owned a pool. I have never bought any pool products.
Anyone received a check yet? are have an idea when they might be sent?
No idea when checks will be out. But it should be soon, hopefully!
