poolTop Class Actions viewers are starting to receive checks in the mail from a class action settlement that accused Pentair Water Pool & Spa Inc., Hayward Industries Inc. and Zodiac Pool Systems Inc. of working together to artificially inflate the price of various pool products in violation of antitrust laws.

According to comments and posts on the Top Class Actions Facebook page, Class Members who filed valid claims for the pool products settlement began receiving checks worth as much as $99.15 on June 2, 2017.

The settlement resolves claims that certain pool products manufacturers engaged in a price-fixing scheme which led consumers to pay more for items such as chemicals, cleaners, pool liners, diving boards etc.

The defendants denied the allegations but agreed to settle the class action to avoid the cost of further litigation. Under the terms of the settlement, Hayward paid $1.5 million, Pentair paid $600,000 and Zodiac agreed to pay $500,000.

Class Members included Arizona, California, Florida and Missouri residents (or entities) who purchased pool products (not for resale) from a pool retailer, builder or service/maintenance company between Jan. 1, 2008 and July 16, 2013.

Covered pool products consisted of “chemicals, pumps, filters, heaters, covers, cleaners, steps, rails, diving boards, pool liners, pool walls, and white goods (the parts necessary to maintain pool equipment) manufactured by Hayward, Pentair or Zodiac and sold by Pool Corporation, or any of its subsidiaries, including but not limited to SCP Distributors LLC (‘SCP’) and Superior Pool Products LLC (‘Superior’), (collectively, ‘PoolCorp’) indirectly to end users.”

The deadline to file a claim for the swimming pool products class action settlement passed on Dec. 11, 2015.
