A settlement has been proposed in a class action lawsuit alleging SuperAmerica violated the Telephone Consumer Protection Act by sending unsolicited text messages to consumers.
If you received a text message from SuperAmerica between Jan. 1, 2012 and April 1, 2015, you may be entitled to a cash payment and other benefits from the TCPA class action settlement.
According to the TCPA class action lawsuit, SuperAmerica sent text message advertisements to cell phone numbers using an automatic telephone dialing system. The plaintiffs assert that these text messages were sent to consumers who had not provided prior express consent to receive such communications from SuperAmerica.
The Telephone Consumer Protection Act prohibits telemarketers and other types of solicitors from contacting consumers without their consent. The TCPA specifically prohibits the use of automatic dialing systems, which store telephone numbers in a database or dials random phone numbers.
The TCPA allows consumers who have received communications that are prohibited by the act to collect compensation of $500 or $1,500 per violation.
SuperAmerica denies the allegations and disputes that it violated the TCPA. However, the company has agreed to settle the TCPA class action lawsuit to avoid the uncertainty, burden and expense of ongoing litigation.
Class Members who would like to opt out of or object to the SuperAmerica TCPA class action settlement must do so no later than May 15, 2017.
Who’s Eligible
Class Members of the SuperAmerica TCPA class action settlement include all persons and entities in the United States who received a text message sent to a cell phone from or on behalf of SuperAmerica through the use of an automatic telephone dialing system from Jan. 1, 2012 through April 1, 2015.
Potential Award
$50 in cash and $50 SuperAmerica gift card.
Class Members who submit timely and valid claims will receive both a cash award of $50 and a SuperAmerica gift card worth $50. Depending on the total number of valid claims submitted, the amount each Class Member receives may be increased or reduced on a pro rata basis.

Its October 2018 and still not a dime..? Or any indication of where or not I’m included.. What’s going on here? TCA can you please address when our checks will be mailed?
Top Class Actions has no control over how quickly claims are paid. You need to contact class counsel with your questions. Counsel is listed in this article and can be Googled for contact information. Good luck.
We have been fooled again!
Nothing yet
TCA could you address this please and thank you.
Top Class Actions is not a settlement administrator. We do not mail checks, and have no control over how quickly checks are mailed. Valid claimants with questions or concerns should contact the settlement administrator or class counsel. Contact information for both of those is available on the settlement website: https://www.satcpasettlement.com/Home/ContactUs
Nothing yet. Really curious to know what happens to these companies who do not follow the courts orders, or if anything at all is done? Are these hearings and cases monitored at all? Or are they just done with it once the attorneys ate paid??
Can you please find out what happened, TCA? Noone has received a check.
Could TCA address this ?
Any proof of checks received?
Still here waiting for my check!!
My son hasn’t either bit I did. I cannot find any lawsuit where a person can verify they were part of the lawsuit.
