A settlement has been proposed in a class action lawsuit alleging SuperAmerica violated the Telephone Consumer Protection Act by sending unsolicited text messages to consumers.
If you received a text message from SuperAmerica between Jan. 1, 2012 and April 1, 2015, you may be entitled to a cash payment and other benefits from the TCPA class action settlement.
According to the TCPA class action lawsuit, SuperAmerica sent text message advertisements to cell phone numbers using an automatic telephone dialing system. The plaintiffs assert that these text messages were sent to consumers who had not provided prior express consent to receive such communications from SuperAmerica.
The Telephone Consumer Protection Act prohibits telemarketers and other types of solicitors from contacting consumers without their consent. The TCPA specifically prohibits the use of automatic dialing systems, which store telephone numbers in a database or dials random phone numbers.
The TCPA allows consumers who have received communications that are prohibited by the act to collect compensation of $500 or $1,500 per violation.
SuperAmerica denies the allegations and disputes that it violated the TCPA. However, the company has agreed to settle the TCPA class action lawsuit to avoid the uncertainty, burden and expense of ongoing litigation.
Class Members who would like to opt out of or object to the SuperAmerica TCPA class action settlement must do so no later than May 15, 2017.
Who’s Eligible
Class Members of the SuperAmerica TCPA class action settlement include all persons and entities in the United States who received a text message sent to a cell phone from or on behalf of SuperAmerica through the use of an automatic telephone dialing system from Jan. 1, 2012 through April 1, 2015.
Potential Award
$50 in cash and $50 SuperAmerica gift card.
Class Members who submit timely and valid claims will receive both a cash award of $50 and a SuperAmerica gift card worth $50. Depending on the total number of valid claims submitted, the amount each Class Member receives may be increased or reduced on a pro rata basis.

Final approval was 2 months ago! Do they always take so long? This was the first one I finally qualified for
I’ve wondered this before on another class action for telemarketing calls.
Maybe somebody could answer it here so I can figure out if I qualify. How do you tell if you’ve gotten text or automated calls from the people when it was so long ago. Especially if ive moved and changed numbers so a mailing wouldn’t get to me.
I never got a letter, wonder what that means??????
I received that same letter. It was in reference to, Notice of INCOMPLETE Claim Form Submission. The same name and address as it appeared on the notice, I filled it out the exact way. It was asking for your name, street address , phone number and today’s date. Made no sense to me as to why they would state that my online form was incomplete.
Letters out asking for more info.

Today’s date is 6/8 and return their letter by 6/19/17.
