Who’s Eligible

Class Members of the class action settlement include all persons who purchased or used the Suave Keratin Infusion Smoothing Kit in the United States before Feb. 17, 2014. The Smoothing Kit must have been purchased for personal or household use.

Potential Award

Up to $10 for a one-time reimbursement. If the claims collectively exceed the amount available in the reimbursement fund, the payments may be reduced pro rata.

Class Members who suffered injuries from the Suave Keratin Smoothing Kit may be eligible for full or partial reimbursement of their treatment costs.

Injury Class: Class Members who suffered bodily injury to their hair or scalp, and who does not timely request exclusion, may submit a claim against the injury fund. There are three options for Class Members seeking benefits under the Injury Fund:

Benefit Option B: Class Members who incurred expenses related to treating their injuries and proof of treatment in the form of receipts may make a claim for reimbursement of their documented expenses in an amount of up to $800 per claimant.

Benefit Option C: Class Members who suffered significant injuries can make a claim to recover damages up to a maximum of $25,000 per claimant. These claims will be evaluated by a court-appointed Special Master, who will determine the amount, if any, that will be paid to each Class Member who submits a claim under Option C.

Proof of Purchase

None required. However, Class Members are encouraged to submit proof of purchase of the Suave Keratin Smoothing Kit as well as receipts documenting the costs of treating their injuries. Submitting these documents may increase the amount of compensation Class Members are eligible to receive.

Case Name

Sidney Reid, et al. v. Unilever United States Inc., et al., Case No. 1:12-cv-06058, in the U.S. District Court for the Northern District of Illinois.

Case Summary

The Suave Keratin Smoothing Kit settlement will resolve a class action lawsuit that alleged Unilever misled consumers into purchasing the product by making false statements concerning the safety of the Smoothing Kit, and by failing to disclose that the Smoothing Kit posed an unreasonable risk of hair and/or scalp injury. Unilever denies any wrongdoing and denies that the Smoothing Kit poses an unreasonable risk of harm to consumers. However, the company agreed to a class action settlement, which was preliminarily approved on Feb. 12, 2014, to avoid the expense and uncertainty of trial.

  1. Roxiaa says:

I finally received my check! Thank God! This has been a long road,

  2. Pam W. says:

Yup, I’m also still waiting. Hope the check comes before Christmas.

  3. Jess says:

Has anyone gotten an estimated timeframe from Dahl? Anything at all months, year, or years? Have been dealing with this since 2012 and just want to put this all behind me. Four years later and I am out of patience. It’s been 5 months since payments went out and I haven’t received anything.

  4. Roxiaa says:

Patiently waiting…………..No release from Medicaid as of yet!

    1. Jess says:

The most frustrating part is not having a timeframe. What if Medicaid takes months or even year (s). Then what? They should just have us sign an affidavit if we didn’t use medicaid/madicare for injuries and hold us liable if we lied.wish I could contact medicaid myself to see what’s the holdup but can’t find a number online for medicaid liens.

  5. Jess says:

I have been told by Dahl that my medicare release came in but my medicaid is still pending. I filed the lawsuit back in 2012. I submitted my medicare/medicaid release back in May 2016. I asked Dahl how long Medicaid has to respond and they said there is no time frame. What if medicaid takes months/years? Then what? I feel there has to be a better process. I haven’t received any correspondence in the mail with an award amount either. I did get a verbal amount when I called but shouldn’t I have received something in the mail so I have it in writing? I even went to http://suave30daysmoothingkitlawsuit.com to see if any updates are available but the website is no longer working. This process has been so exhausting and I am out of patience. This is so frustrating especially since I have no liens since I never used medicare/medicaid for suave related injuries. There should be an affidavit we can sign stating we didn’t use these so the payment can be mailed to us. Does anyone have any recent updates?

  6. Pam W. says:

Yup I’m still waiting as well.

  7. Roxiaa says:

    Still waiting on Medicaid release….

  8. class member says:

I really was hoping we all got the full settement especially knowing we got less and the overage just goes back to the company oh well ….received my check 10/21 long wait is over for me I hope everybody else got theirs or will get theirs real soon

    1. Jess says:

Hi just wondering what you meant by getting less and the overage going to the company. Are there fees I am not aware of? I thought the attorneys and any other charges where paid by a separate fund not the amount we are supposed to get? Thanks!

      1. class member says:

whatever is left over after everybody is paid it goes back to suave usually in a settlement all the funds leftover are distributed to the class members. And the amounts some people got was less than others. Suave stipulated in the agreement that they wanted the leftover funds returned to their company instead of going to the class members

  9. Pam W. says:

Thanks for the info. And yes God is very good all the time. Still on my check, it will come right on time. Amen

  10. Jasmine frazha says:

I called the number that James said he CALLED to verify medicare/medicaid and THAT NUMBER IS NOT IN EXISTENCE. Why do you people play games on this website.
