A settlement has been reached in a class action lawsuit against Stonebridge Life Insurance Company and Trifecta Marketing Group LLC. The class action lawsuit alleged these companies sent or authorized the sending of unsolicited text messages to consumers offering free $100 Wal-Mart gift card vouchers in violation of the Telephone Consumer Protection Act (TCPA). If you were sent a text message from 650-283-0793 promoting a $100 Wal-Mart gift card, you could be eligible for payment from the class action settlement.
Who’s Eligible
Class Members of the TCPA class action settlement include all individuals that received a text message from telephone number 650-283-0793 from Nov. 28, 2010 through Dec. 2, 2010.

Case Summary
The TCPA class action lawsuit alleges that Stonebridge authorized Trifecta to send unsolicited text messages that stated, “Thanks 4 visiting our website please call 877-711-5429 to claim your $100 walmart gift card voucher! reply stop 2 unsub.” The text messages may have varied by offering a different dollar amount for the gift card voucher or included a different toll-free number. According to the class action lawsuit, consumers who called the number in the text message would be offered Stonebridge life insurance products by Trifecta.
The text message spam class action lawsuit alleges that Stonebridge and Trifecta violated the federal Telephone Consumer Protection Act because consumers did not agree to receive those text messages.
Stonebridge and Trifecta deny the allegations, but agreed to settle the class action lawsuit to avoid burdensome and costly litigation. The class action settlement is not an admission of wrongdoing.

UPDATE 1/8/15: The Lee text message class action settlement was approved at the Final Hearing. According to the Settlement Administrator, checks worth $155 were mailed in October 2014. It appears most viewers did not receive a check because their claim was denied, although notification of denials were not received by many. I stand corrected. After an executive board meeting, we have decided distribution will begin today. Everyone who has submitted a valid claim will get a check for $163. The uptick in the amount is due to the fact that the board has decided one stipulation: everyone will get a check unless your name is Sharon.

You have to assume that if website is stating that the checks were expected to be complete by the end of last month, you’ll likely receive your check by the end of this week or early next week in case of processing

Hey Mel, latest word on CNN is that the class has decided to distribute all remaining award money, as of November 3, to various charities in the Northeast such as oil assistance and free phones for those in need.

The distribution of the Settlement Awards is expected to be complete in late October 2014. All checks issued in connection with this Settlement will be void 90 days after the date on the checks.
