Sprint surcharges class action settlement

A settlement has been reached in a class action lawsuit alleging that Sprint Communications Company improperly disclosed and/or collected certain monthly charges from individual customers. If you are a current or former Sprint account holder and were charged or subject to Sprint surcharges on any or all wireless lines of service from Jan. 1, 2007 and Oct. 8, 2013, you could be eligible to receive either cash or non-cash benefits.

Who’s Eligible

Class Members of the Sprint surcharges class action settlement include all current and former consumer accountholders who were charged or subject to Sprint surcharges on any or all wireless lines of service from Jan. 1, 2007 and Oct. 8, 2013. The Settlement Class does not include governmental or corporate accounts. The class action settlement also established a sub-class of individuals who did not receive notice of the Sprint surcharge increases. The Sub-Class Members generally fall into one or more of the following categories:

  • Individual Liable Accounts that were opened on or after November 11, 2007, and on or before December 31, 2007;
  • Individual Liable Accounts that were on suspension on November 11, 2007, but that were subsequently reinstated;
  • Individual Liable Accounts that were opened on or after October 5, 2008, and on or before December 31, 2008;
  • Individual Liable Accounts that were on suspension on October 5, 2008, but that were subsequently reinstated;
  • Individual Liable Accounts that were opened as new accounts in Sprint retail stores in 2009;
  • Individual Liable Accounts that were opened on or after November 8, 2009, and on or before December 31, 2009; and
  • Individual Liable Accounts that were on suspension on November 8, 2009, but that were subsequently reinstated.
Potential Award

Varies. Class Members will be eligible to choose a cash benefit valued at $1 or one of the following non-cash benefits from the class action settlement:

  • A 30-minute long distance, domestic calling card;
  • A 30 percent discount on any accessory purchased at a Sprint-owned retail store, limited to one accessory; or
  • A waiver of the $36 activation fee when activating a new line of service under Sprint’s then-existing Terms & Conditions of Services.

Case Summary

The Sprint surcharge settlement will resolve a class action lawsuit (Barkwell, et al. v. Sprint Communications Company) that alleges Sprint improperly disclosed and/or charged certain monthly surcharges that the company collects to defray costs including but not limited to costs associated with government programs and network connections.

Sprint has denied the allegations but has agreed to a class action settlement that was preliminarily approved on Oct. 10, 2013. Under the terms of the settlement, Sprint will review and revise its policies to clearly inform consumers about the surcharges.

    $1.00 I cant remember how many class action law suits i have been a part of,you lawyers add me to the list of clients when you go to court, but when you all get the money, you remove me from the list, because i no longer qualify, sounds like a dirty scam to me. but we are Americans we go to the polls and vote people into office who make laws that takes advantage of hard working people, class action law suits benefits the lawyers not the people.If the surcharge was wrong, the money should come to the people. $1.00 please.

    I have multiple issues with Sprint. I swear there is something constantly with them. I also read that Sprint in MN alone has over 36k complaints.

    For me, I have service only while I am at home due to them having to give me an airwave so that I can get calls. Otherwise, I experience dropped calls, calls going straight to voice mail instead of people being able to reach me. Text messages not going through. It has been this way for over 6 months. When I would ask Sprint Customer Care about it they would say next month it will be done – every time. When I confronted them on their lies I was put to Sprint Executive Care which is a step up from regular Customer Care. They started giving me a discount on my bill. Yet the service remains the same. I am told that 75 percent of the country will be upgraded by June of 2014. I have the option of changing carriers, but one thing Sprint does have is one of the better phone plans that work for me. I have been researching other carriers, yet might kick up my search harder after today. I got this month’s bill for $298! My bill is typically $148 which they have been discounting so it is lower than that. I added on my grandmother due to not wanting her to be without. This should have brought my bill up $20. I get the whole pro-rating for that one phone, I get needing to pay the activation fee, but seriously, how did it get that high? I called. Apparently Sprint messed up the billing by $81.

    I have now signed up for the Class Action Lawsuit. I hope that Sprint starts improving and gets the hint. I thank those that started this!

    All the cell phone company do the same not only sprint, let’s sue them all . And let’s not bring up Time Warner Cable. Let Sue Time Warner too they just as bad check out your Bill.

    How do I excluded my self from the claim. I did not have sprint phone on that time line . I had one a few years before that. Sad to say, but they do not owe me, I left them owing a bill. Thank You,

    Better off going with another company that is not Sprint. Try TING waste not want not and only pay for what you use.

    I’m a single mom that works a full time job plus a part time job it’s really sad that Sprint could be so greedy to add extra charges to so many people.Do they need money that bad?Have they gone without eating so their children could go to bed with full stomachs?I use to tell others Sprint was a good provider,but I will not encourage anyone to sign up with a company that thinks it’s o.k.to take from hard working people.And by the way,keep the dollar seems you need it more than I do.

    What? Is this “class-action suit” just for the lawyers to get paid?? What is a dollar when mailing it would cost almost half that? All the years that I paid these surcharges only add up to $1.00? This gives a new meaning to the word, frivolous. Even $20.00 wouldn’t make me feel any better. The notice I received said in effect: “Screw you!”

    For $1 I’m not going to waste my time looking for my account number or phone number that I had back then, which one is recommended to qualify to be included in the lawsuit.
