Spirit_Airlines

A settlement has been reached in a class action lawsuit alleging Spirit Airlines Inc. violated the Fair and Accurate Credit Transactions Act by printing more than the last five digits of customers’ credit and debit card numbers on receipts.

If you used an airport kiosk for a transaction with Spirit Airlines and used a credit card to pay for services between Aug. 29, 2012 and Oct. 28, 2015, you may be entitled to benefits from the Spirit Airlines FACTA class action settlement.

If approved, this FACTA settlement will resolve two class action lawsuits (Christopher W. Legg v. Spirit Airlines Inc. and Joseph Rosen v. Spirit Airlines Inc.) that accuse Spirit Airlines of issuing receipts for point-of-sale credit and debit card transactions that displayed more than the last five digits of the payment card number in violation of FACTA.

Spirit Airlines denies any wrongdoing, but agreed to pay a total of $7.5 million to settle the FACTA class action lawsuit and avoid the burden and expense of trial.

Class Members who wish to opt out of or object to the Spirit Airlines FACTA settlement must do so no later than June 20, 2016.

Who’s Eligible

Class Members of the FACTA settlement include: “All individuals in the United States who: (i) made a payment to Spirit Airlines (ii) using a debit or credit card, and (iii) for which Spirit printed a point of sale receipt (iv) that displayed more than the last 5 digits of the card number (v) after August 29, 2012.”

Potential Award

Up to $1,000.

Class Members who submit timely and valid Claim Forms will receive a pro rata distribution of the settlement fund, up to a maximum payment of $1,000. The actual amount each Class Member receives will depend on the total number of claims that are filed. Class Counsel estimates that claimants will receive a payment of about $265.

      The effective date of the settlement is approximately September 2, 2016, (30 days after the settlement received final approval). The settlement agreement states that checks will be mailed within 45 days of the effective date. Hopefully viewers will see checks arrive in October. Please let us know when you receive your check!

    Credit Card companies are now providing customer information when it’s requested for FACTA lawsuits. That’s how this settlement has a class list.
