Spirit Airlines agreed to an $8.25 million settlement to resolve claims that it charged illegal carry-on bag fees despite promising passengers they could bring a bag with no additional charge.

The settlement benefits individuals who booked a flight on Spirit Airlines through Expedia, Kiwi, CheapOair, CheapTickets, Travelocity or Bookit between Aug. 31, 2011, and May 3, 2017, for a flight that was the class member’s first flight on Spirit after Aug. 1, 2010, and who paid a carry-on bag fee.

According to the class action lawsuit, consumers purchased Spirit Airlines tickets from online travel agents based on the promise that they would be able to bring a carry-on bag without incurring additional charges. In reality, Spirit Airlines allegedly reneged on this deal and charged additional fees when passengers showed up with carry-on bags.

Spirit Airlines is a budget airline that offers flights in America, the Caribbean and Latin America.

Spirit Airlines hasn’t admitted any wrongdoing but agreed to a $8.25 million settlement to resolve the carry-on fee class action lawsuit.

Under the terms of the settlement, class members can receive up to 75% of the carry-on bag fee they paid for their first Spirit Airlines fee during the class period. Actual refunds may be lower than 75% depending on the number of claims filed. No payment estimates are available at this time.

The deadline for exclusion and objection is Nov. 11, 2023.

The final approval hearing for the settlement is scheduled for Dec. 11, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by Jan. 10, 2024.

    Today is January 10th, 2024, I want to file a claim because I took a trip on Spirit Airlines out of Oakland, California back in 2011 and I purchase the ticket through cheap tickets.com and I was told that there was no fees for carry on badge when I purchased my ticket and when I got to the airport they charged me $160.00 for both luggage’s and they wouldn’t let me board with the small carryon luggage.

    I tried to submit a claim today (01/10/2024) and the claim website show that “The deadline to submit a Claim has passed”. Today should be the last day to submit. Can someone please find out why this was shut down early? Thank you.
