Six Continents Hotels Inc. has agreed to pay $11.7 million to settle a class action lawsuit alleging it recorded and monitored telephone calls to its toll-free reservations and customer service lines without notifying the callers, in violation of California law. If you lived in or were located in California and called one or more of Six Continents’ hotels on a toll-free number and spoke to a representative between March 1, 2011 and July 18, 2012, you could be entitled to a cash payment from the class action settlement.
The Six Continents call recording lawsuit was filed in September 2012. The plaintiffs alleged they placed phone calls to Six Continents’ toll-free numbers to inquire about the hotels’ rates and reservations. According to their class action lawsuit, they provided sensitive personal information (such as credit card information) during the calls, and they were never informed during the call that the conversation was being recorded.
Six Continents has denied the allegations but agreed to settle the call recording class action lawsuit to avoid the uncertainty and cost associated with litigation. The Six Continents call recording settlement was preliminarily approved on June 30, 2015.
UPDATE: According to the settlement website, checks will be mailed out no later than Apr. 22, 2016. If you filed a timely and valid Claim Form keep an eye on your mailbox, your pay-out should be arriving soon!
UPDATE 2: On Apr. 25, 2016, Top Class Actions readers started receiving settlement checks worth as much as $245.98.
Who’s Eligible
You are a Class Member of the Six Continents call recording settlement if, while residing or located in California, you called one of the following hotels on a toll-free number between March 1, 2011 and July 18, 2012 and spoke with a representative:
- Priority Club Rewards
- Holiday Inn
- Holiday Inn Express
- Crowne Plaza Hotels and Resorts
- Intercontinental Hotels and Resorts
- Staybridge Suites
- Candlewood Suites
- Hotel Indigo
Potential Award
$100 (estimated). The actual amount each claimant receives may be higher or lower depending on the total number of claims that are filed. The payment to any individual claimant will not exceed $5,000, no matter how few Class Members file claims.

Hello my name is Mimi received the check today. Took it to my bank they said the check wouldn’t scan. Is anyone else having this problem. Please let me know. The check us for $ 245.98. They wouldn’t let me deposit the check at all!!!!!!
I went to a local ” Cash checks here ” stop & they cashed it with no implications..
Any bank thats telling you a check wont scan is FOS. They dont even use scsnners anymore its just an excuse to not cash it. You can get a real bank and do a mobile deposit or reach out to their corporate office and complain.

Sorry to hear that you’re having problems also. What I did was take it to another Wells Fargo bank. I deposited the check and the funds were available right then and there. Hope everything works out for you Kat..

The checks will be approximately $215.38. You can read it for yourself…. go to the claims administrator website and look at the document NOTICE AND MPA FOR FEE MOTION (go to page 10 on that document). It says each payment will be approximately $215.38. Good luck everyone.
