Proof of Purchase Required: No proof of purchase is necessary, but the claim form requires each Class Member to verify they received a printed at least one receipt at a Safeway fuel station between Sept. 12, 2017, and Feb. 26, 2019, and that the information the Class Member is providing is true and correct to the best of their knowledge and belief.

Safeway agreed to a $20 million settlement to resolve claims that it violated the Fair and Accurate Credit Transactions Act (FACTA) by including card numbers on customer receipts.

The settlement benefits consumers who made a purchase using a debit or credit card at any Safeway gas station between Sept. 12, 2017, and Feb. 26, 2019, and received a receipt showing the first six and last four digits of their card number. 

Safeway-affiliated locations included in the settlement may operate under the following brand names: Albertsons, Acme, Carrs, Randalls, Jewel, Tom Thumb, and Vons.

Safeway is a sub-unit of Albertsons Companies — a large food-and-drug retailer with locations across 35 states. Safeway started as a small, family-owned grocery store in Idaho in 1915.

Consumers claim Safeway fails to comply with federal law and puts their sensitive payment information at risk. 

According to a 2019 class action lawsuit against Safeway, the gas station company unlawfully printed receipts which contained more payment card information than allowed under federal law. Plaintiffs in the case contend these receipts violated FACTA.

FACTA protects consumer information by standardizing the amount of payment card data that can be printed on receipts. Under the law, only the last five digits of a payment card number can be included on a receipt while no expiration data information can be included. Businesses must comply with FACTA by truncating — replacing digits with symbols — card information on electronically printed receipts. 

The FACTA class action lawsuit contends Safeway fails to follow the law by including the first six and last four digits of payment card numbers on printed receipts. This failure allegedly compromises customer information and puts consumers at risk for fraud and identity theft.

Safeway hasn’t admitted any wrongdoing under FACTA but agreed to resolve these allegations with a $20 million class action settlement.

Under the terms of the Safeway lawsuit settlement, Class Members can collect a cash payment. 

According to the settlement website, payments are estimated to be between $18 and $36. Exact payment amounts will vary depending on the number of claims filed by Class Members.

The settlement agreement also stipulates that no excess funds will revert back to Safeway. Instead, any unused funds from the settlement will be used to fund either a second payment distribution or cy pres awards to the National Consumer Law Center and the Chicago Bar Foundation.

The deadline for exclusion and objection is April 4, 2022. 

The final approval hearing for the Safeway lawsuit settlement is scheduled for May 4, 2022.

In order to benefit from the Safeway class action settlement, Class Members must submit a valid claim form by April 4, 2022.

    The downloadable PDF claim form states that the last four digits of the credit card used to make purchase (allows two entries only), as well as a copy of the receipt is required:

    “You must also provide as an attachment to this form a copy of your receipt that shows the date, store name, and store location.”

    I have purchased Safeway gas many times, but do not print receipts at the pump, and I do not remember which credit card I used, as I have many.

    Can the claim form requirements be amended to include people like me?

      Correction: the downloadable PDF claim form allows for only one credit card entry, asking for the first six digits, and the last four digits, of the credit card used to make the Safeway gas purchase. The claim form is a breach of privacy in itself, as ten digits of the associated credit card number is required and then mailed, faxed, or telephoned in:

      “YOUR CLAIM FORM MUST BE SUBMITTED ELECTRONICALLY OR VIA TELEPHONE OR POSTMARKED ON OR BEFORE APRIL 4, 2022.”
