A settlement has been reached in a class action lawsuit alleging Rust-Oleum Corporation improperly labeled its Rust-Oleum 2X spray paint products as having twice the coverage of competing brands.
If you purchased Rust-Oleum 2X spray paint products between Dec. 12, 2011 and May 30, 2017, you may be entitled to a cash payment from the Rust-Oleum class action settlement.
The Rust-Oleum spray paint products covered by the class action settlement include:
- Rust-Oleum Painter’s Touch Ultra Cover 2X Spray Paint
- Rust-Oleum Painter’s Touch 2X Ultra Cover Spray Paint
- Rust-Oleum PaintPlus Ultra Cover 2X Spray Paint
- Rust-Oleum American Accents Ultra Cover 2X Spray Paint
- Rust-Oleum American Accents 2X Ultra Cover Spray Paint
The Rust-Oleum 2X spray paint class action lawsuit was initially filed in December 2016 by plaintiff Daryl White Jr. He alleges the Rust-Oleum 2X spray paint packaging deceived consumers into believing it contained twice the coverage of competing brands, even though it did not provide twice the coverage of other brands.
White asserted claims for breach of express warranty, breach of implied warranty, unjust enrichment, and other claims.
Rust-Oleum denies any wrongdoing and maintains its products were truthfully labeled and marketed. However, it has agreed to settle the Rust-Oleum 2X class action lawsuit to avoid the burden and expense of ongoing litigation.
In addition to providing cash benefits to Class Members who submit timely and valid claims, Rust-Oleum has also agreed not to make certain marketing claims that were challenged in the Rust-Oleum spray paint class action lawsuit.
The Rust-Oleum 2X spray paint class action settlement was preliminarily approved on May 30, 2017.
The deadline to opt out of or object to the Rust-Oleum class action settlement is Aug. 28, 2017.
UPDATE: On Dec. 18, 2017, Top Class Actions viewers started to receive checks in the mail worth as much as $6 from a class action settlement that alleged certain Rust-Oleum spray paints were falsely advertised as being able to produce twice the amount of coverage when compared to other spray paints on the market.
Who’s Eligible
Class Members of the Rust-Oleum 2X spray paint settlement include anyone who purchased any Rust-Oleum 2X spray paint products in the United States for personal use and not for resale between Dec. 12, 2011 and May 30, 2017.
Potential Award
Up to $20 per household.
Class Members may elect Tier 1, Tier 2 or Tier 3 benefits.
Tier 1: Class Members who do not have valid proof of purchase may submit a Tier 1 claim for a maximum of $1 per product, up to a maximum of three products. The maximum possible payment for Tier 1 claimants is $3 per household.
Tier 2: Class Members who do not have valid proof of purchase but who provide additional information about their purchases may recover up to $1.50 per product, up to a maximum of four products. The maximum possible payment for Tier 2 claimants is $6 per household.
Tier 3: Class Members who provide proof of purchase are eligible for a refund of the price of the products purchased, up to a total of $20 per household.
Proof of Purchase
Not required. However, claimants who do not provide proof of purchase are limited to a recovery of only $3 or $4 per household. Class Members who submit proof of purchase may claim up to $20.

Tier 3 claimer I buy a case of this paint a month. I referbish old furniture and donate to the needy. It’s just a hobby. I like the paint but I hate the false advertising Please add me

I just bought a can of Rust-Oleum 2X in June. Why was the cut off the end of May when they are still advertising it the same way?
tier 3 claimant…requires a value of 1 to 3 to be entered on the form ,which does not apply to a tier 3 claimant ….what is wrong with the developers who designed the form ? No common sense …and never tested the software.
