Rust-Oleum-Painters-spray-paintTop Class Actions viewers are starting to receive checks in the mail from a class action settlement that alleged certain Rust-Oleum spray paints were falsely advertised as being able to produce twice the amount of coverage when compared to other spray paints on the market.

According to comments and posts on the Top Class Actions Facebook page, Class Members who filed valid claims for the Rust-Oleum 2X spray paint settlement began receiving checks checks worth up to $6 on Dec. 18, 2017.

The class action settlement resolves allegations that Rust-Oleum 2X spray paints were falsely marketed in a way that could trick shoppers into thinking one can of spray paint could provide twice the coverage. The Rust-Oleum class action lawsuit alleged breach of implied warranty, breach of express warranty, along with other claims.

Class Members included all U.S. consumers who purchased any of the following spray paints between Dec. 12, 2011 and May 30, 2017:

  • Rust-Oleum Painter’s Touch Ultra Cover 2X Spray Paint
  • Rust-Oleum Painter’s Touch 2X Ultra Cover Spray Paint
  • Rust-Oleum PaintPlus Ultra Cover 2X Spray Paint
  • Rust-Oleum American Accents Ultra Cover 2X Spray Paint
  • Rust-Oleum American Accents 2X Ultra Cover Spray Paint

 

Consumers who filed a claim for the Rust-Oleum settlement had the option of submitting a proof of purchase to receive up to $20, or if they were unable to provide a receipt they were limited to $3 or $4 per household.

Rust-Oleum denied the allegations but agreed to terms of the settlement, which included changing certain marketing claims, in order to avoid the cost and risk of further litigation.

The deadline to file a claim for the Rust-Oleum spray paint class action settlement passed on Oct. 16, 2017.
