On Oct. 19, 2020, the Court approved updates to the Settlement Agreement that include extending the date to file your claim, submitting an exclusion request, and filing an objection. Additionally, the updated Roundup Settlement provides that, in the event that the total value of claims falls short of the amount in the Common Fund, payments will be increased from 10% of the weighted average retail price of the products claimed to an amount not to exceed 50% of the weighted average retail price of the products claimed.

The updated Roundup Settlement also identifies the applicable statutes of limitations for Class Members who purchased the Products in any U.S. territory. If you have already filed a claim, no further action is needed in order for you to be eligible for the potential increase in payment; however, you may choose to amend your current claim submission or withdraw your exclusion request. If you have not already filed a claim, information on filing a claim is provided below.

A $39,550,000 settlement has been reached in a Roundup® Weed & Grass Killer class action lawsuit alleging that labeling on certain Roundup® Weed & Grass Killer products are false and misleading. The Roundup settlement includes consumers who purchased one of the following Roundup® Weed & Grass Killer products that includes the statement “targets an enzyme found in plants but not in people or pets” or a similar assertion on the labeling.

  • Roundup® Ready-to-Use Weed & Grass Killer III;
  • Roundup® Ready-to-Use Weed & Grass Killer Plus;
  • Roundup® Weed & Grass Killer Concentrate Plus; or
  • Roundup® Weed & Grass Killer Super Concentrate

The Roundup® class action lawsuit claimed Monsanto falsely labeled certain products, reasoning that Roundup® Weed & Grass Killer only targets an enzyme in plants and not in people or pets.

This Roundup® class action lawsuit is about product labeling, not personal injury. Plaintiffs argue Monsanto was unjustly enriched and consumers economically damaged by the false advertising of the product’s labeling.

“Plaintiffs and other Class Members who purchased the Roundup® Products suffered economic damages in a similar manner because they purchased more Roundup® Products and/or paid more for Roundup® Products than they would have had they not been deceived,” the complaint stated, noting the plaintiff was not seeking any damages for personal injuries as part of the Roundup® class action lawsuit.

Monsanto admitted no liability, but agreed to pay $39.5 million to end the class action lawsuit. In addition to paying out Class Member claims, along with plaintiffs’ awards and attorneys’ fees, the company has agreed to change its labeling practices as part of the Roundup settlement.

Specifically, Monsanto has agreed to stop using labeling that indicates Roundup® Weed & Grass Killer only targets an enzyme found in plants. The language will be replaced with a statement indicating ingredients target an enzyme “essential for plant growth.”

Class Members will be able to claim partial refunds for certain Roundup® products.

The updated Roundup settlement provides that, in the event that the total value of claims falls short of the amount in the Common Fund, payments will be increased from 10% of the weighted average retail price of the products claimed to an amount not to exceed 50% of the weighted average retail price of the products purchased during the Class Period, which depends on the statute of limitations in the Class Member’s state.

Class Members unable to submit proof of purchase are limited to claim one unit per household per year within the Class Period (with the exception of the largest Roundup® Weed & Grass Killer Super Concentrate product, for which claims are limited to 1 unit every 2 years) and awards as high as $53.15 in the Roundup settlement. Class Members can submit a Claim Form online or by mail and must do so by the extended claims deadline, Feb. 16, 2021.

Class Members who wish to opt out of the Roundup® settlement must do so by Feb. 16, 2021, as well. Objections to the settlement must be filed by March 8, 2021. The final hearing is scheduled for March 11, 2021.

Who’s Eligible

Class Members include those who purchased one of the following Roundup® Weed & Grass Killer products during the Class Period, including:

  • Roundup® Ready-to-Use Weed & Grass Killer III;
  • Roundup® Ready-to-Use Weed & Grass Killer Plus;
  • Roundup® Weed & Grass Killer Concentrate Plus; or
  • Roundup® Weed & Grass Killer Super Concentrate

The products must have included the statement “targets an enzyme found in plants but not in people or pets” or a similar assertion on the labeling.

Potential Award

Up to $53.15 per unit claimed, after pro rata adjustment, without proof of purchase.

No maximum for claims supported by reasonable proof of purchase.

Proof of Purchase

Proof of purchase is required for Class Members whose claims exceed 1 unit per household per year within the Class Period (with the exception of the largest Roundup® Weed & Grass Killer Super Concentrate product, for which claims are limited to 1 unit every 2 years).

    Recieved response from claims admin that checks are going out on a rolling basis starting June 15 and for claimants who opted for digital payments, they have yet to go out but will shortly. No specific date was given. Hope that helps.

    Odd! So many people were commenting yesterday which means it sounds like people have now received their checks but they are not any comments so far today here at all. I bet they’re going to be so many people that don’t end up getting their payments just like many other class action lawsuits. And it really sucks for people especially with proof provided. If people were getting their checks today like yesterday, it’s weird that people wouldn’t be on here saying so

      Really? there’s NO WAY that they have mailed out all of the checks. I am aware that of course the checks will be dated for the 15th but being dated for the 15th is not the same thing as sending them out on the 15th or even on the 16th. The money is still with them until the check is in fact cashed. I see that they say wait up to 14 days but that they’ve already sent out all the checks, there’s no way! Mail does not run by horse and buggy. If all checks were sent out then every last person should already have it by now if not then FOR SURE by Friday (today) & that includes considering Sunday and the holiday! Most of these lawsuits are about companies being deceptive & I don’t and will not put it past the attorneys to be just as deceptive, besides you can just look at how much they take from the class action lawsuits for themselves & THAT tells you all you need to know about them! I think for me I’m personally just fed up with spending all my money on companies that make these products that are deceptive, defective, make claims that aren’t true about their products etc the list goes on and you never end up getting the same money back that you ended up spending on these products either. Today I see that day listed that there was a bunch of frozen fruit from Walmart now too that’s being recalled which we have in our freezer as we speak and we’ve been buying for a long time, that I used to make my sons smoothies all of the time. I think it’s okay for people to be upset and to loose faith in believing what these companies have to say about what they are selling us and all at the same time not only have we been paying way too much for the products already but now they’ve been increasing prices. When is enough enough? So, yes I’m going to call it like I see it and I’m going to say that’s bs when they want people to really think that it’s normal to take up to 14 days to receive a check LOL and to say that they’ve already mailed them too! Let’s be real, it’s kind of obvious that they sent out a batch, that batch is dated the 15th just like the rest of them and they sent some of them out. They’re letting a little bit go every day maybe or even every two or three days. And I wouldn’t put it past them to wait until Monday again to start sending out another batch because they know that it typically takes 3 days for mail to get delivered. But let’s stretch it and let’s say that we will give them 5 days, even if you consider the 5 days, if they wait until Monday then it will still fall within that 14-day period time frame that they are giving people and when people receive their checks dated for the 15th, they attorneys can say SEEEEEE….we sent them out like we said on the 15th as if we do not know the difference between the date on the check and the mailing date. We all also know that most times , most male does not show the date that it’s actually mailed on the front of the envelope. Only some mail is stamps showing the actual date that was mailed. Which they are aware of. I’m ONLY saying this bc ppl, it’s obvious as heck! You cannot sit back and tell people that you’ve sent out all checks but then even with five business days, all people still have not received their checks! There’s NO way that it takes more than 5 business days for that many ppl to still be waiting. Also I found out that if you are receiving payments digitally that they said that can also take up the 14 days too which is kind of weird considering it’s supposed to be a digital payment which either comes through your email to redeem through a MasterCard I believe, zelle, or direct deposit. Anyway, that’s my rant….I call it like I see it and idc who see it! I work for my money and I want to be able to buy reliable products and not constantly be given the runaround. The biggest insult and I think the part that makes me personally irritated and what draws the line is whenever attorneys or these people want to treat you like you’re an idiot and I personally find it comical but they have enough guts to tell people that it can take 14 days to receive a check and that’s actually think that people will believe that bs. I’m not going to apologize for wanting my money back ESPECIALLY when I sent in my proof. If anything , payments should go out to the people who sent in proof first.

            I live in Ohio too…still nothing! I heard them say that it can take up to 10 business days. At least that’s what they said. Which tells me that although they have cut the checks, they are only sending out so many this week and then they’ll send out so many the next week as well. A lot of these attorneys or companies, they keep money as long as they possibly can , and it means interest while keeping it. So even if they made the checks and even if they’re dated for the 15th, they haven’t yet been sent to us and until they’re cashed they are not out of their account yet. So considering they said 10 business days, they are aware that that means that because of the holiday on Monday this week, that we still could end up not seeing it until the end of next week for others.
