Did you register for the dating website PositiveSingles.com or any other website indicating it was “Powered by PositiveSingles.com” since 2007? You may be eligible to receive a refund of your membership fees from a class action lawsuit settlement.
The PositiveSingles.com settlement resolves two class action lawsuits (collectively known as Doe v. SuccessfulMatch.com) that accuse SuccessfulMatch.com of using false and misleading information on its websites to attract members and displayed profiles and photographs of PositiveSingles.com members without their permission.
SuccessfulMatch.com runs a series of dating websites, including PositiveSingles.com, an anonymous dating site for people with herpes, HPV, HIV/AIDS, Hepatitis and other sexually transmitted diseases.
Plaintiffs in the class action lawsuit generally allege that the Defendant deceived them into believing that their private and personal information on the PositiveSingles website could not be accessed without their consent. As a result, Plaintiffs became members of SuccessfulMatch.com and paid membership fees to SuccessfulMatch.com. Plaintiffs are alleging claims for Unfair Competition (California Business and Professions Code § 17200 et seq.) and violation of the Consumer Legal Remedies Act (California Civil Code § 1750 et seq.).
SuccessfulMatch.com denies any wrongdoing but agreed to establish a $4.2 million class action settlement fund to resolve the litigation and avoid the expense and uncertainty of going to trial.
UPDATE: Due to confusing language in the court-approved distribution plan, we erroneously reported that distribution of payments would go out in March 2016. However, Top Class Actions has discovered that online daters who filed a a claim for the PositiveSingles.com class action settlement should expect distribution after final funding is received in September 2018. Who’s Eligible
This class action settlement includes two types of individuals:
Non-California Class Members: all persons who registered for use of the PositiveSingles.com website or any other website indicating that it was “Powered by PositiveSingles.com” during the period beginning on Oct. 13, 2007 and ending on Feb. 20, 2015.
California Class Members: All residents of the State of California who registered for use of the PositiveSingles.com website or any other website indicating that it was “Powered by PositiveSingles.com” during the period beginning on Oct. 13, 2007 and ending on March 15, 2013.
Potential Award
Varies.
Non-California Class Members who submit a valid Claim Form will receive a check equal to the total amount they paid in membership fees to SuccessfulMatch.com during the Non-California Class Period.
California Class Members will receive a check equal the remaining amount of the Settlement Fund available at that time (net of Claim Administrator fees and costs, service awards, Class Counsel’s attorneys’ fees and costs, and checks to Non-California Class Members) divided proportionately by the membership fees paid to SuccessfulMatch.com by each California Class Member during the California Class Period.
It is expected that payments to California Class Members will be slightly greater than the amount that each Class Member paid in membership fees to SuccessfulMatch.com during the California Class Period.
Plaintiffs will submit a Plan of Distribution to the Court that will provide more detail on payments to be made to Class Members. The Plan of Distribution will be filed before the Final Approval Hearing and will be posted on the Settlement website: www.PositiveSinglesClassCertification.com.
