Perrigo glucosamine class action settlement

A settlement has been reached in a class action lawsuit against Walgreen Co., Wal-Mart Stores Inc., Supervalu Inc., and Perrigo Company of South Carolina Inc., alleging that certain statements on the packaging of some of their glucosamine supplements were false, deceptive and/or misleading. If you purchased certain glucosamine products between Nov. 1, 2005 and Aug. 1, 2014, you could be eligible for compensation from the Perrigo class action settlement.

Specifically, the Perrigo class action lawsuit alleges that products containing glucosamine and/or chondroitin were represented as formulated to help “rebuild cartilage,” “lubricate joints,” and “improve joint comfort” when they do not actually provide these benefits. The plaintiffs claim that these representations are unlawful under the consumer protection laws and that the purchasers of these products are entitled to compensation.

The defendants deny the allegations but agreed to settle the glucosamine class action lawsuit to avoid the risk, expense and distraction of continued litigation.

Who’s Eligible

Class Members of the Perrigo glucosamine class action settlement include all U.S. residents who purchased for personal use, and not resale or distribution, a Covered Product between Nov. 1, 2005 and Aug. 1, 2014. A list of Covered Products is available here.

Potential Award

$12 per bottle, up to a maximum of eight bottles per household, to Class Members who do not submit proof of purchase.

Class Members who submit valid Claim Forms accompanied by a cash register receipt evidencing their purchase of a Covered Product manufactured by Perrigo and/or its affiliates will be entitled to receive a full refund for the actual price of each product purchased.

The actual amount each Class Member will receive depends on the total number of valid claims submitted, and may be adjusted up or down in order to fully distribute the class action settlement funds to all Class Members who submit valid claims.

Proof of Purchase

None required. However, Class Members who do not provide proof of purchase will be limited to an award of $12 per bottle, up to a maximum of eight bottles per household. Class Members who submit receipts with their Claim Forms may be entitled to full refunds of all Covered Products purchased.

  3. Jason says:

It didn’t state per person. But clearly without proof (8) bottles allowed. So i guess if you split it 4/4 you would both get checks. If not probably only 1 person.

Has anyone else received a letter stating that they were denying their claim because of more than one claim from the same address? Both me and my sister received this letter, and we have different last names, and live by ourselves at different addresses, so we know that there would not be any other claims from our addresses. We both wrote back to the administrator of the settlement, questioning how this could be.I was just wondering if anyone else received this letter from them, and you know that they are wrong.

    1. Jimmie says:

Yes, my wife and I both submitted claims, she got a rejection post card stating 1 per household. It sounds like they dont want to pay you.

    2. Anthoney says:

I receive the same post card denying my wife as well. The post card reads 1 per HOUSEHOLD. Oh-well I will know better next time.

Emails from Admin: ” Claims will be paid when and if we choose, and at our discretion, no claims will be paid if it proves to be too much burden on our systems”. So there it is, no one is going to receive payments. Both Plantiff Consuel and the courts have been informed of this, so this may getting to another Claims Admin.
