Ambit Northeast LLC has agreed to pay $9.3 million to settle a class action lawsuit alleging it engaged in a bait-and-switch scheme to trick customers into buying its services.
If you were enrolled in the Select Variable Plan for electricity with Ambit Northeast in Pennsylvania between Jan. 1, 2011 and Feb. 22, 2018, you may be entitled to benefits from the class action settlement.
According to the Ambit class action lawsuit, the energy company distributed a disclosure statement to its Pennsylvania electricity customers on its Select Variable Plan which limited Ambit’s right to vary its electricity rates.
Plaintiff Amy Silvis asserts Ambit breached its contract with its customers by varying its electricity rates in ways that were not allowed under the terms of the disclosure agreement.
The Ambit class action lawsuit accuses the energy provider of advertising “teaser rates” to entice customers to join their variable energy program. Silvis claims Ambit offered a one-month teaser rate at a fraction of the cost under the program and then charged them twice that amount the next month.
Ambit denies the allegations but agreed to settle the class action lawsuit to avoid the cost and risk of trial. The company argued that the rate increase was related to record winter temperatures and was not a bait-and-switch scheme meant to dupe customers.
The Ambit class action settlement was preliminarily approved on Feb. 22, 2018.
Class Members who would like to opt out of or object to the Ambit Energy settlement must do so no later than May 4, 2018.
Who’s Eligible
Class Members of the Ambit Energy settlement include anyone in Pennsylvania who was enrolled as an Ambit customer and who was on Ambit’s Select Variable Plan at any time from Jan. 1, 2011 through Feb. 22, 2018.

Either two percent or 15 percent of the amount paid to Ambit.
Class Members with a date of enrollment as an Ambit customer between Jan. 1, 2011 and Jan. 12, 2014 will receive a check in the amount of 15 percent of all amounts paid to Ambit while the Class Member was on the Select Variable Plan.

Received my check $652.86 01/28/2019 Hard to calculate if this 2% or 15% I like everyone else who think ? back to the bills we paid over time……always think the higher end. I’11 call tomorrow.
I never got mine at all.
I got mine today, but I think I was suppose get the 15%, i don’t think I got it. I’m calling.
Yeah I had 2 accounts dating back to 2011 and received only $58. We moved in 2016 and signed back up Ambit. There’s nobody to call and sent 2 emails with no reply. Let me know how you do.
I was scheduled due to post office to recieve my check yesterday and didn’t… Anyone get theirs? If so what was the roundabout of your check?
Check came today 11/19/2018.
Got mine too
I got mine too but walmart denied cashing it. Did anyone else have a problem with cashing it?
how much was it?
How much
How much
Did the checks get sent out yet
When can we expect checks arrive? We have have NOT heard a thing since submitting our claim. This was by far one of the worst experiences primarily because we had no clue till our electric provider told us about price hikes during prime winter months!! We have been with this company since they began.. Ugh!!
May I ask who gave you this info? No need for us all to email the same place.
I got a response from the email above and it said IF there are no bumps in the road they would issue checks “in early winter.” So you can interpret that as you please.
I also received a response from above email that said late November.
You should have gotten your check recently…
I filled out the form and have not heard anything!
If I haven’t received one and I should have, who do I call?

There is a 30 day period from the final approval in which appeals can be filed. It is not known how quickly claims will be paid if there are not any appeals filed. You can contact the settlement administrator with your questions: Questions@PAElectricitySettlement.com
