Ambit Energy class action lawsuit

Ambit Northeast LLC has agreed to pay $9.3 million to settle a class action lawsuit alleging it engaged in a bait-and-switch scheme to trick customers into buying its services.

If you were enrolled in the Select Variable Plan for electricity with Ambit Northeast in Pennsylvania between Jan. 1, 2011 and Feb. 22, 2018, you may be entitled to benefits from the class action settlement.

According to the Ambit class action lawsuit, the energy company distributed a disclosure statement to its Pennsylvania electricity customers on its Select Variable Plan which limited Ambit’s right to vary its electricity rates.

Plaintiff Amy Silvis asserts Ambit breached its contract with its customers by varying its electricity rates in ways that were not allowed under the terms of the disclosure agreement.

The Ambit class action lawsuit accuses the energy provider of advertising “teaser rates” to entice customers to join their variable energy program. Silvis claims Ambit offered a one-month teaser rate at a fraction of the cost under the program and then charged them twice that amount the next month.

Ambit denies the allegations but agreed to settle the class action lawsuit to avoid the cost and risk of trial. The company argued that the rate increase was related to record winter temperatures and was not a bait-and-switch scheme meant to dupe customers.

The Ambit class action settlement was preliminarily approved on Feb. 22, 2018.

Class Members who would like to opt out of or object to the Ambit Energy settlement must do so no later than May 4, 2018.

Who’s Eligible

Class Members of the Ambit Energy settlement include anyone in Pennsylvania who was enrolled as an Ambit customer and who was on Ambit’s Select Variable Plan at any time from Jan. 1, 2011 through Feb. 22, 2018.

Potential Award

Either two percent or 15 percent of the amount paid to Ambit.

Class Members with a date of enrollment as an Ambit customer between Jan. 1, 2011 and Jan. 12, 2014 will receive a check in the amount of 15 percent of all amounts paid to Ambit while the Class Member was on the Select Variable Plan.

Class Members with a date of enrollment as an Ambit customer between Jan. 13, 2014 and Feb. 22, 2018 will receive a check in the amount of two percent of all amounts paid to Ambit while the Class Member was on the Select Variable Plan.

Proof of Purchase

Class Members who received a personalized notice in the mail or via email should provide the Claim Number and Confirmation Code included on the notice.

    We here in Illinois have the same problem as well with this company. They workers come out and ask for your bill talking about making sure your getting a good rate and then they switching your company. How can Illinois get started on a claim?

    Calling 18557863979 was a joke…waste of time…thought would be able to learn wh a claimant. Now need to confer with Cousel for Claimant…no phone number…need ans prior to signing claim form…goes back to 2011
