Papa John's text settlementDetails on how to file a claim for the Papa John’s text spam settlement have arrived! If you received an unsolicited text message from Papa John’s, you may be eligible to claim $50 cash from the class action lawsuit settlement.

The Papa John’s pizza text settlement will resolve a 2010 class action lawsuit (Agne, et al. v. Papa John’s International Inc., et al.) accusing the pizza chain of sending more than 500,000 illegal text messages to Papa John’s customers advertising pizza specials. The text messages were illegal, plaintiffs say, because they were sent without the customers’ consent and with the use of an automatic dialing system in violation of the TCPA.

Papa John’s continues to deny it did anything wrong in sending the text messages, arguing that customers gave consent to the messages when they provided their telephone numbers when purchasing a pizza. The company also maintains that — as a franchisor — it is not liable for the actions of its franchisees, which were the ones who hired the marketing company OnTime4U to send the text messages.

OnTime4U is also listed as a defendant in the Papa John’s pizza class action lawsuit.

Despite these arguments, which a federal judge rejected last year, the defendants have agreed to establish a $16.5 million class action lawsuit settlement to resolve the litigation.

Class Members of the Papa John’s class action settlement include all persons in the United States who received at least one unsolicited text message that marketed a Papa John’s branded product, good or service through OnTime4U.

Class Members that submit a valid Claim From will receive $50 from the class action settlement. Each potential Class Member will also receive a voucher code good for the online purchase of one free large one-topping pizza from Papa John’s.

You do not have to file a Claim Form to receive the free Papa John’s pizza voucher. However, you must submit a valid Claim Form by September 10, 2013 to receive the cash award.

    I posted earlier that I had not received this check but I remembered that we decided not to pursue this one. We were eligible for both this one and the 1-800 contacts lawsuit. Both are handled by Rust . Based on the history of Rust not paying out when you file for too many class action lawsuits, even if you have receipts and get a notice from them, we decided that we didn’t want to risk the possible high payout of the 1-800 lawsuit, considering we both qualified. He wears contacts so there were calls from both of our phones and both of our business phones. We decided to pass on the $50 each that we would have received for this one because we didn’t want Rust leaving us out of the higher 1-800-contacts lawsuit. It’s unfortunate that Rust has “blacklisted” consumers from filing too much, even consumers who Rust contact directly with a claim number.

    We made sure to fax, e-mail, and certify mail both of our forms the day before the deadline. There is no way that Rust can tell us that they didn’t receive anything from us.

    I DON’T SEE ANYTHING ON THE WEBSITE ABOUT THEM BEING ISSUED.

    Everbody in Florida I talked to got there’s one person is on her way to get her pizza now before they snatch that back but I haven’t received one and I no am filling the form out because i get a confirmation code

    Is anyone actually sure these checks went out? are they for this settlement? this company has a habit of not paying out for at least 6 months to a year on alot of these lawsuits, no update? it just ended on 9/10, thats kinda early for them to send a check?

    Liza you hit it right on nose. Everyone should read Lizas both comments. Settlement Administrator like Rust and damm GCG how much they eat and cheat. You do the math. Sweet girl is so right.

    I too have not received a check. I did not fill out the form until the end of August so I am going to give it some more time.

    Here is a thought!! We stop filing the claims and the lawyers have nothing to go to court with. This should stop the $$$$$$ going in their pockets.

    I did a search on Rust Consulting the other day and read a complaint from this 77 year old lady having to do with a Settlement they are cheating her on and it brought me to tears .

    Google ~ Complaints against Rust Consulting. They ripped off a lot of people with the , National Mortgage Settlement,
    and so, so much more.
