Consumers who purchased an Onn power bank or portable charger from Walmart may be able to benefit from a $1.1 million class action settlement.
The settlement benefits individuals who purchased an Onn power bank from Walmart – either online or in-store – between Jan. 1, 2013 and July 9, 2020.
Plaintiffs in the Onn power bank class action lawsuit claim that Walmart misrepresented the power capacity of their Onn portable charger products. Allegedly, the mobile chargers did not provide the power represented by Walmart. As a result, the customers say they were deceived into overpaying for Onn power banks due to false representations.
Onn portable charger products are reportedly advertised with various charging capacities – listed in mAh – which consumers use to make a purchasing decision. Although the represented power capacity is supposed to accurately indicate how much a power bank can be used before it needs to be recharged, Walmart allegedly inflated these numbers to drive consumer sales.
As a result, consumers reportedly purchased Onn power bank products which had a smaller charging capacity than they were led to believe.
Additionally, plaintiffs and other consumers reportedly paid more than they should have for the products due to the inflated power rating. If the products had been accurately advertised, consumers allegedly would have not purchased the Onn power bank products or would have paid significantly less.
“By deceiving consumers about the Power Banks’ capacities as detailed herein, Defendant is able to sell more of, and charge more for, the Power Banks than the Company could if they were labeled accurately,” the Onn power bank class action lawsuit contends.
“Further, Defendant was also motivated to mislead consumers to take away market share from competing products, thereby increasing its own sales and profits.”
Walmart has not admitted any wrongdoing but has agreed to settle the case against them with a $1.1 million settlement. The deal allows both parties to put the allegations to rest, benefit from the deal, and avoid the risks of continuing litigation.
Under the terms of the settlement, Class Members will be able to collect a cash payment for the Onn power bank products they purchased. Payment amounts will be distributed on a proportional basis depending on the number of purchases claimed and the net settlement fund after fees and costs are deducted.
In order to benefit from the settlement, Class Members must file a valid claim form by Nov. 19, 2020. Class Members can claim as many products as they purchased, but must provide proof of purchase if they wish to claim more than five products. Claim forms can be filed either online or by printing a claim form from the settlement website and mailing it to the settlement administrator.
The deadline for exclusion and objection is Nov. 4, 2020. The final approval hearing for the Onn power bank class action settlement is Nov. 30, 2020.
