A proposed settlement has been reached in a class action lawsuit against Pfizer Inc. and Warner-Lambert Company LLC regarding the marketing of the prescription drug Neurontin. The class action settlement provides cash awards to Third-Party Payors (TPP) of Neurontin, including all insurance companies, health benefit providers, and entities that provide prescription drug benefits and/or pharmacy benefits (i.e., consumers are not included).

If you are a TPP and purchased, paid for, administered and/or reimbursed for branded or generic gabapentin sold by Pfizer and its subsidiaries, you could be eligible for benefits from the Neurontin class action settlement.

The Neurontin class action lawsuit alleged the defendants violated the law by promoting Neurontin for various uses that were not approved by the U.S. Food and Drug Administration (FDA) and for various conditions for which it was ineffective. According to the class action lawsuit, Neurontin was approved by the FDA as an adjunctive therapy for adult epilepsy and for the treatment of post-herpetic neuralgia. However, the plaintiffs allege that the defendants marketed the drug for several off-label uses by making false or misleading statements to physicians and in medical publications. The Neurontin class action lawsuit also alleged that Class Members paid inflated prices for the drug.

The defendants have denied the allegations but agreed to settle the Neurontin class action lawsuit to avoid further expense, inconvenience and the burden of litigation.

Who’s Eligible

Eligible Class Members of the Neurontin class action settlement include third party payors in the United States who purchased, paid for, administered, and/or reimbursed for Neurontin sold by Pfizer and Warner-Lambert or gabapentin sold by Greenstone LLC.

Third party payors are all insurance companies, healthcare benefit providers, health maintenance organizations, union health and welfare plans, self-funded health and welfare plans, and any other health benefit provider and/or entity that contracts with a health insurance company or other entity to serve as a third party claims administrator to administer their prescription drug benefits.

Subclass A includes Assurant Health Inc., Blue Cross and Blue Shield of Florida Inc., Louisiana Health Service & Indemnity Company d/b/a Blue Cross Blue Shield of Louisiana, Blue Cross Blue Shield of Massachusetts, Blue Cross Blue Shield of Michigan, Blue Cross Blue Shield of Minnesota; CareFirst Inc., Blue Cross Blue Shield of Delaware Inc., Excellus Health Plan Inc., Federated Mutual Insurance Company, Group Health Service of Oklahoma d/b/a Blue Cross Blue Shield of Oklahoma, Health Care Service Corporation, Mutual of Omaha Insurance Company, Trustmark Insurance Company, WellChoice Inc. and WellChoice Insurance of New Jersey Inc.

Potential Award

The $325 million Neurontin class action settlement fund will be distributed proportionally among Class Members based on the size of their claims according to the plan of distribution.

The payment that members of Subclass A will receive will be calculated by multiplying their actual amount of Neurontin purchases by 1.8. For example, if a member of Subclass A files a claim for $10,000 of Neurontin purchases, that number would be multiplied by 1.8 and $18,000 will be used to calculate the pro rata portion of the class action settlement proceeds.

Proof of Purchase

Class Members are required to provide the amount of branded Neurontin they purchased from Jan. 1, 2003 to June 30, 2004. This “proxy period” will be used to determine the payments made to each Class Member.

Class Members submitting claims for purchases during the proxy period of more than $300,000 must provide documentation with their Claim Form.

    I’m in Australia I was given Gabapentin for spinal damage, fibromyalgia I was on it for year I suffer from memory loss and can’t work because of it. It has ruin my life.
    How can I get in on this class action.

        They secretly did this case about Gabapentin. 2/19/2023 Im just seeing & learning about the lawsuit and I still have 5 large filled bottles of Gabapentin. 8yrs I was prescribed that medication for a herniated disk “pain”.

    where did the money won from this lawsuit go ??I’ve been on GABAPENTIN for 20 years and just find out this is the reason I can’t remember anything I’m suffering severe memory loss I’m really suffering I live alone and find it extremely difficult to do daily task and why wasn’t this made public oo I know why because it was big time insurance companies benefiting from us Americans I feel very violated buy them and all the doctors that knew about this not caring about there patients

    Since 2006 I was prescribed Neurontin/ Gabapentin until a recently, in 2006 I had an accident in which damaged my spinal cord, In 2007 I had to undergo Spinal surgery which I was prescribed gabapentin and it was a medication I had to take 1 and 2 times a day for many years , I lived in memory loss and confussion .. I felt like a zombie I was a wreck .

      I was prescribed gabapentin/ neurontin back in 1997 and have been off of it for 2 years now. My memory is shot and I kept repeating myself. It caused my depression to get worse also. How do I get on the list for the consumer part of the class action lawsuit? My daughter now lives with me because of my memory loss issues and why didn’t I get taken off of it before 2 years ago? I mean come on I was taking it 3x a day at 800 milligrams each time for 22 years.

    I was prescribed fentanyl for seven years and gabapentin for five years. They destroyed my life. Three years ago I requested to be taken off all my medications. I live alone and I am just now starting to have brief moments when I can think clearly. The class actions for both of these are closed. I was not mentally capable to add myself to those class actions at the times when it was available. How is this fair?

      I was diagnosed with fibromyalgia in 2004 due to pain throughout by body . Kaiser doctors & Anthem blue cross doctors prescribe Gabapentin 300 mg I have been taking for over 8 years up to a few months ago was my my last prescription. Also , in 2017 damage lumbar area . And workers Comp doctors increase the amount of gabapentin went from 2x daily to 3x daily . My nerve pain increases and unable to sleep at night so I stopped it . I now developed headaches which gives me Vertigo and forgetfulness and major Never pain throughout my body . I had no idea of the lawsuit until saw a commercial regarding Gabapentin. It’s so unfair to the rest of us who suffers everyday from this medication .

    I was prescribed neurotoxin during this period. Bit I read several times that the consumer isn’t eligible only the pharmacies and insurance companies. But the consumer is the one who paid those premiums to the insurance companies. So why are we not eligible? And if we are then could someone inform me of where to go and what I need to do to get in on this? Thank you

    My doctor prescribed me gabapentin for my nerve pain that I was going through in my foot I was using it for almost a year.and due to using it I have been having memory lose and my kidney have been bothering me at times.

    I have been taken neurotin since 2009 and was switched to Lyrica in 2016,because it didn’t work for my Hereditary Neuropathy. I was taken the maximum dosage 3x a day. So do I still qualify for the suit or did they keep it private for all the rich people until the suit was settled. And now they published it on the NBC News and the newspapers. I guess they didn’t want anybody else to know!!. Shame on you!!!.

      I was talking gabapentin, from 2014 to 2016, 3 times a day.after an accident and need surgery on my neck, I had a two level
      Disc replacement, with a fusion. I do believe , to have suffered side effects, including mild memory loss, and effects on my teeth.
      I am on medi- Cal, do I still qualify?

      Please read up on Lyrica. I was prescribed it for alledgedly having fibromyalgia. The side effects didn’t start right away so when they did start the doctor was treating those symptoms just like they all do. It wasn’t good and if not for a good friend who was astonished by the handful of medications I was taking and wrote down the names and doses of each one along with why I was taking the particular medicine and looked them up and read up on them, I would probably still be bed ridden or in a nursing home. Now I hardly take any medicines that are prescribed. Blood tests showed that I was extremely low on vitamin D B6 Biotin Magnesium and one other that I can’t remember off hand. When I questioned my doctor about the results(I get the results emailed to me also), he only looked at whatever the lab had highlighted and only addressed those. When I brought it to his attention he said no there is nothing wrong with any of those levels. He showed me where after each test result like say vitamin D, the lab had levels that was considered in the range. You know, between this number and that. So I showed the Dr the past 6 test results and noted that no matter what the numbers were the lab would have the acceptable levels so that my results fell in the middle. Problem was the difference from test to test was extreme. Then I showed him what the levels are supposed to be for a man of my age and such. He said well the only problem I can see as far as writing you a script for the vitamins, nutrients or testosterone that you really do need is your insurance won’t pay for it if the lab doesn’t say you aren’t within the acceptable limits.
      So I buy my own medicines and now the Dr pays attention to the numbers. Hopefully for all his patients.
      It’s so hard for me to not be hateful and feel sorry for myself because of the months I spent in bed agonizing over symptoms that were due to a deficiency in vitamins and nutrients mostly. Also got pretty upset over the Lyrica that created more problems than it was supposed to help. But if I dwell on it I will never get out of bed. I hope and pray for everyone who has these ailments like fibromyalgia that there is really no way to prove it or cure it so people in the medical field throw answers at it blindfolded.     I was prescribed gabapentin, 600 mg 3 times daily for pain in my neck and arm caused by kyphosis of the cervical spine. I have 4 discs the doctor wants to remove and fuse together. I have chosen not to have the surgery until the technology catches up to my disease and the longterm survival rate improves. I also was perscribed losartan, and naproxen the doctor knew i was on gabapentin. ive been taking the gabapentin for over a year now and have also have sexual disfunction which i did not have prior to taking gabapentin, i have the begining of nonalcoholic fatty liver diease and numorous other side effects issues i didnt have it prior to taking gabapentin. why are doctors still prescribing it and how can i now be compensated for my injuries cause by it do i have a case ? sorry for the typis and misspells. the drug has also made me stupid.

    I recently heard that Neurontin and gabapentin have been linked to suicides. My husband of 35 years was taking this drug for several years for restless leg syndrome. He died through suicide with traces of gabapentin found in his liver on autopsy.
    This was in 2016
    Do I have a case?
