A proposed settlement has been reached in a class action lawsuit against Pfizer Inc. and Warner-Lambert Company LLC regarding the marketing of the prescription drug Neurontin. The class action settlement provides cash awards to Third-Party Payors (TPP) of Neurontin, including all insurance companies, health benefit providers, and entities that provide prescription drug benefits and/or pharmacy benefits (i.e., consumers are not included).

If you are a TPP and purchased, paid for, administered and/or reimbursed for branded or generic gabapentin sold by Pfizer and its subsidiaries, you could be eligible for benefits from the Neurontin class action settlement.

The Neurontin class action lawsuit alleged the defendants violated the law by promoting Neurontin for various uses that were not approved by the U.S. Food and Drug Administration (FDA) and for various conditions for which it was ineffective. According to the class action lawsuit, Neurontin was approved by the FDA as an adjunctive therapy for adult epilepsy and for the treatment of post-herpetic neuralgia. However, the plaintiffs allege that the defendants marketed the drug for several off-label uses by making false or misleading statements to physicians and in medical publications. The Neurontin class action lawsuit also alleged that Class Members paid inflated prices for the drug.

The defendants have denied the allegations but agreed to settle the Neurontin class action lawsuit to avoid further expense, inconvenience and the burden of litigation.

Who’s Eligible

Eligible Class Members of the Neurontin class action settlement include third party payors in the United States who purchased, paid for, administered, and/or reimbursed for Neurontin sold by Pfizer and Warner-Lambert or gabapentin sold by Greenstone LLC.

Third party payors are all insurance companies, healthcare benefit providers, health maintenance organizations, union health and welfare plans, self-funded health and welfare plans, and any other health benefit provider and/or entity that contracts with a health insurance company or other entity to serve as a third party claims administrator to administer their prescription drug benefits.

Subclass A includes Assurant Health Inc., Blue Cross and Blue Shield of Florida Inc., Louisiana Health Service & Indemnity Company d/b/a Blue Cross Blue Shield of Louisiana, Blue Cross Blue Shield of Massachusetts, Blue Cross Blue Shield of Michigan, Blue Cross Blue Shield of Minnesota; CareFirst Inc., Blue Cross Blue Shield of Delaware Inc., Excellus Health Plan Inc., Federated Mutual Insurance Company, Group Health Service of Oklahoma d/b/a Blue Cross Blue Shield of Oklahoma, Health Care Service Corporation, Mutual of Omaha Insurance Company, Trustmark Insurance Company, WellChoice Inc. and WellChoice Insurance of New Jersey Inc.

Potential Award

The $325 million Neurontin class action settlement fund will be distributed proportionally among Class Members based on the size of their claims according to the plan of distribution.

The payment that members of Subclass A will receive will be calculated by multiplying their actual amount of Neurontin purchases by 1.8. For example, if a member of Subclass A files a claim for $10,000 of Neurontin purchases, that number would be multiplied by 1.8 and $18,000 will be used to calculate the pro rata portion of the class action settlement proceeds.

Proof of Purchase

Class Members are required to provide the amount of branded Neurontin they purchased from Jan. 1, 2003 to June 30, 2004. This “proxy period” will be used to determine the payments made to each Class Member.

Class Members submitting claims for purchases during the proxy period of more than $300,000 must provide documentation with their Claim Form.

    This is all driven by money. I have many “complicated” medical issues, was prescribed Gabapetin, my emphysema worsened to the point I couldn’t walk two steps without losing my breath. Shortness of breath, potential of lung machine and death are all side effects and someone should have caught this. The side effects from withdrawal are 300% worse then taking the meds. And it was a pain management doctor that prescribed this along with a 24 hr opioid. If I cannot improve my lung function back to where it was before I was put on this medication, you can be damm sure I’m suing!

      I just lost my dad to lung failure and found out he had been on this medication for bi polar for years!! Did you ever sue and if so who’s did you have as an attorney?

    I was on Neurontin/gabapentin from 2002 – 2013 if I remember correctly. My entire life has changed because of this drug. I was once happy and a go getter now I hide in the home and worry what will go wrong, at any time in the day or even at any minute of the day. I have been diagnosed through the Veteran Affairs with posttraumatic stress disorder, chronic with bipolar 1 disorder, moderate with anxious distress. I have a daily struggle to keep calm and I often have a hard time remember stuff said to me within 5 minutes. Their are many other things I can tell you over the phone. When I first started taking this drug I put a loaded gun in my mouth for about 15 minutes thinking if I should pull the trigger and also gave the gun to another person asking the to kill me. I was normal before this drug and without a police record and now this has all changed. It was given to me for pain management and not how it was allow to be used for, and now I even see new side-affects versus what I have seen. I take Lithium carbonate, sertraline HCL, and prazosin HCL, this helps, but not a cure. This is what I take if order to have some kind of life when going out into public these days, if I do not take these meds I get into altercations with other people. I have a hard time recognize social cues, also I feel easily manipulated by others and they treat me poorly, I cannot predict how my actions are sometimes because of Neurontin/Gabapentin with is a very dangerous drug for any person regardless of situation.

    I have been itching and scratching so badly on and off over the past 4 yrs and told oh it could be my psoriasis changing, well thats bull because i have had it on the palms of my hands and soles of my feet for 26 yrs, it has never spread, i get pustules hence the name palmer pustular psoriasis. i am now covered in dark scars!! I have been on this for about 4 yrs after getting peripheral neuropathy from methotrexate which was prescribed for palmer pustular psoriasis. I have since being on this drug been diagnosed with plantars faciitis which will not go away even after 2 surgeries. I only just found out that one of the many side effects of gabapentin are swelling of the hands and feet which obviously has caused major issues with my psoriasis! I have ended up in the er with such bad pain in my feet, told oh its the peripheral neuropathy caused by the methotrexate here take this gabapentin now to find this has more than likely caused most of my major health issues these past 4 yrs! My psoriasis on my feet which i have photos of has been unbearable to the point my feet were purple and bloody! I have gained 40 lbs since being on this drug and i do not have a poor or over indulgent diet!!! I am majorly depressed sometimes envisioning a death i cannot wait to happen! I have asked if any of the meds i have been on could be causing any of these things only to have my psoriasis meds changed but oh no never these!!! I was weaned off everything but my pain med for surgery in november and recalling how it seemed like a miracle my feet did not literally kill me when i stepped out of bed in the morning, well after the past three wks of my legs feeling so heavy and the pain in my legs waking me in the middle of the night i decided to wean myself off this drug and amazing how i am able to get out of bed in the morning and walk normal! I dont have to hold the railing of my staircase with both hands and walk one step at a time sideways! I have basically missed out on my 6 yr old daughters last 4 yrs of her life which are irreplaceable and i had to quit working 2 yrs ago this march. I am ready to leave my marriage because i feel horrible putting my poor husband through this all because of this drug, it has ruined my life, my self esteem, sense of worth, my body which i dont care as much about my weight but i am literally scarred every inch from these rashes that come and go. I need legal help and a good dr that knows how to see these things in my numerous medical records which thank god are all with the same dr!

    My feet and hands swelled which made my psoriasis on my feet unbearable and i have now been on 6 diff psoriasis meds due to the side effects of the gabapentin who knows what all these diff biologics meds have done as far a permanent damage! I see my dr every month and every 6 wks for remicade infusion.

    Please let me know if you can help me or direct me as i am going 2 yrs with zero income. Our household income dropped by 1/3 and my constant health issues have me so lost and in pain i dont know what to do

    I very much hope that there is more to this than I’m reading, as I have been on this drug for a quite a few years now and it was prescribed ‘off label’ yet has been more effective than anything else (other than a narcotic which is not a an ideal option for anyone to be on long term). I am sorry that this drug did not work for others if prescribed off label but I hardly feel as though my doctor did so because he was receiving a kick-back from any drug company (he won’t even meet pharmaceutical reps, as it takes time away from his patients) and I get my Rx filled at Walgreens, not from a doctor anyway. I’m also hoping that since this names a very specific time period of January 1, 2003 to June of 2004 that since then, Pfizer et al. have cleaned up their act…sadly even 325 million dollars is only a drop in a very large bucket these days when it comes to big pharmaceutical companies yet I can’t say I could live comfortably w/o medication, this being one of them so I am still shocked to even see that there was an issue with this drug. Such a shame.

      I for one am very happy that you are not having any negative side effects from this drug. And I’m glad it works to help with your condition. But please read up on it very closely to view possible long term damage it does and just for the sake of argument, try other medications that are closely related but without the known long term effects and see how you feel then. The worse that could happen is you end up back on the original medicine. Best of wishes.

    I agree, both my father-in-law and I were prescribed and took neurontin for two very different ailments. him, Parkinsons…err suspected Parkinsons and i was told it would help my chronic back pain. my father-in-law had two dosages dispensed with noticeable indication of the change which could’ve led to him taking 600MG more a day
    he got 100 MG three times a day and the 300mg to be taken once at bedtime. unsafe…but a different case altogether. I am sure many are asking the same-what about the consumer? what does it take to initiate the questions being answered to those given this medication with real pain and symptoms which needed to be treated and who were misled? and what side effects occurred in those who took for something it did not treat?! I am sure many are asking these same questions and want answers! thanks.

      The therapeutic index is very high for this drug, meaning, it takes a VERY large dose for it to be unsafe. The therapeutic index (also known as therapeutic ratio) is a comparison of the amount of a therapeutic agent that causes the therapeutic effect to the amount that causes death (in animal studies) or toxicity (in human studies). Quantitatively, it is the ratio given by the lethal or toxic dose divided by the therapeutic dose.

      Anyway, doses up to 2400 mg have been well tolerated and even 3600 mg under a relatively short duration. Furthermore, this drug is actually metabolized more the kidneys rather than the liver making it a more desirable option for many. That said, impaired renal function may not get along very well with this but any doctor would know that. Just because a drug either didn’t work or even made you feel pretty crummy doesn’t entitle you to compensation necessarily. Heck, I think we have all been there unfortunately; that is the nature of having complex medical issues and I would hate to think where I would be if my doctor had not tried this drug for me for example. I also think that should I ever be faced with the choice of certain cancer treatments, despite the very nasty side effects, I would still go for it. Just food for thought. Did all of you “buy” this drug during the dates specified as well? If not, you’re still out of luck anyway so perhaps that will make you feel less left out as the consumer. Take care.

        I was prescribed 4000 mg a day during that time period. Sure wish I had known about this before the time ran out. Doesn’t seem fair that I was not notified.

          I have been taking neurotins since 2011 when diagnosed with Rheumatoid arthritis.& now have even more health issues can I qualify for this lawsuit…
