Details: National City Bank and PNC Bank (PNC) have reached a $12 million class action lawsuit settlement concerning illegal overdraft fees. If you paid overdraft fees to National City (including accounts transferred to PNC when it merged with National City in November 2009), you may be eligible to receive a cash payment from the class action settlement that could be as much as $100 or more.

According to the National City Bank class action lawsuit settlement, titled Trombley, et al. v. National City Bank, et al., National City improperly assessed overdraft fees for insufficient funds on debit card purchases and ATM withdrawals in a number of ways that were unlawful, including by “re-sequencing” transactions in order to maximize the number of overdraft fees. The lawsuit alleges that these practices were unlawful and caused financial injury.

You’re considered a class member of the National City overdraft fee settlement if you hold or ever held a National City Account and at any time from July 1, 2005 through August 15, 2010 incurred at least one Overdraft Fee associated with at least one National City Debit Card Transaction that was not previously reversed, refunded or returned. (The settlement does not apply to any PNC accounts that were opened for the first time through PNC or one of PNC’s predecessor banks other than National City. It does, however apply to National City account holders who were charged fees before or after National City was merged into PNC.)

As part of the $12 million National City class action settlement, National City will pay class members $36 for each eligible Overdraft Fee they incurred during the class period. However, if the number of people filing claims is small enough, you may be able to receive up to three times this amount!

All you have to do to receive your share of the National City cash settlement is to submit a valid claim form no later than August 26, 2011.     IF you do the math. Over 195,000 people involved in the lawsuit. If we each got 40 bucks, that adds up to over 7 million. They only have around 8 million left after the lawyers, etc..were paid. Just letting you know because I know so many of you are waiting and hoping for something big this week, like myself. I don’t think it will happen.

    After reading several things online, It is apparent we should not expect anymore than 30-45 dollars, no matter the amount of overdraft fees were involved. Myself, they owe me hundreds.
    It is upsetting. For a year now I have waited for this lawsuit to be over with. Now sometime this week I expect a check for equal to one overdraft fee.

    I called today and spoke with a lady who checked on my information and said Yes computer was telling her I was elidegible to receive a check from settlement, and they were set to mail out on Wednesday. She said she did not have the information to tell me how much, but said if I wanted to call back on Wednesday, she could give me the total amount of check mailed.

    Thanks for the updates. I also wondered where and when the funds were coming. NCB is way over due in paying these amounts back to their valued customers. Yea for the 23rd!

    I called yesterday, May 15, to see if the 23rd was set a “go” and the nice gal assured me “yes”. I asked her if there was any way to check how much we were getting (it should be a considerable amount) and she told me that at this time, no and she doesn’t know if they are going to give that info to the peeps answering the phones. Further told me, not a chance they will go earlier than the 23rd as they were all being mailed in 1 batch.

    I checked in January 12, someone had appealed. I was advised it was going to take another 6 to 12months. Today 3/5/12, I talked with Olivia at the 800 number and she verified my information and the claims are now being processed and will go out on May 23rd, 2012!!!!!!! Yipeeeeee

    PNC needs to be investigated, as they are doing the same thing. I will be closing my accounts with them. They are not to be trusted!
