Mylan agreed to pay $264 million as part of a class action lawsuit settlement to resolve claims it worked with Pfizer and other companies to raise the cost of the EpiPen.

The settlement benefits individuals and entities who paid for or provided reimbursement for branded EpiPens or generic equivalents between Aug. 24, 2011, and Nov. 1, 2020.

EpiPens are epinephrine injectors used to save people from life-threatening allergic reactions. Mylan, a Vitaris company, makes the branded version of EpiPen, but there are authorized generics available as well.

Unfortunately, according to a 2017 class action lawsuit, Mylan may have worked with Pfizer to artificially raise the price of life saving EpiPen products. Plaintiffs in the class action lawsuit claimed the companies knowingly violated antitrust and racketeering laws through their scheme.

“Defendants devised an illegal scheme to monopolize the market for epinephrine autoinjector devices,” the Mylan EpiPen class action lawsuit contends. “As a result, millions of Americans relying on this life-saving device have paid exorbitant prices for EpiPens that are in no way tethered to or constrained by a competitive market.”

In 2016, Mylan allegedly increased the price of EpiPens by over 600 percent — from $100 in 2007 to $608 in 2016. According to the plaintiffs, this price increase was part of Mylan’s alleged antitrust agreement with Pfizer, “driven solely by unaccountable executives and companies who sought to profit off of human misery and fear.”

To support its scheme, Mylan allegedly misclassified EpiPens under Medicaid’s rebate program, engaged in deceptive marketing, restrained competition, used invalid patents to block generics, and more. These actions prompted a 2017 investigation by the Federal Trade Commission.

Mylan hasn’t admitted any wrongdoing, but agreed to pay $264 million to resolve these allegations. Pfizer agreed to a similar settlement of $345 million in 2021.

Under the terms of the settlement, Class Members can receive a payment from one of two pools of funds. The first fund, which accounts for 20 percent of the net settlement fund, benefits individual consumers who purchased EpiPens. The second fund, made up of the remaining 80 percent of the net settlement fund, benefits third-party payors, such as insurance companies who paid for or reimbursed consumers for EpiPens.

Exact payment amounts will vary depending on the number of valid claims filed in each pool. 

The deadline for objection is June 8, 2022. 

The final approval hearing for the Mylan EpiPen settlement is scheduled for July 6, 2022.

In order to receive a payout from the EpiPen class action settlement, Class Members must submit a valid claim form by July 25, 2022. 

Class Members who submitted a claim form with the Pfizer settlement in 2021 do not have to submit a claim, as this form will be used by the Mylan EpiPen class action lawsuit settlement to disburse any payout in 2022.

    I tried to put mine on PayPal it didn’t work. I called PayPal and they said it was added to my Pay Pal card but it never showed up. These cards are making people very upset. I tried Walmart Store ,pay my cable bill and other bills. It worked when you get food from McDonald’s.

    Why is this virtual master card so difficult to use i tried registering it add it to both of my accounts from apple and PayPal even tried to buy something online but the website PayPal and apple all declined my card but all of sudden when ordering a physical card it suddenly worked i don’t know if the company who owns the virtual gift cards are crooks and only let me use my amount on the gift if i gave them the 3 dollars this virtual card was nothing but a headache i got my card on a Saturday and i thought i needed to wait until Monday so i could work that wasn’t it i tried using it and i still get a declined message when ordering stuff online even right now i can’t use it I’m feeling super frustrated then i got a check from a different settlement and the lazy customer service worker at Walmart told me i couldn’t cash settlement or recall checks cause they stopped doing them when a month ago i perfectly cashed a settlement check with a problem now I’m stuck thinking of using mobile checking on my PayPal account but I’m too worried if i put my ss number i might either get hacked or my ssdi payments would get mess up

    Anyone knows how to get money out (transfer to bank or get cash)once I get the physical card???
    btw,I called the number on my virtual card and asked for a physical, it will be in my mailbox about 2 weeks.

      If you can find an ATM with tap technology enabled, you should be able to withdrawal those digital funds

    I still haven’t received anything. No emails and no check and I did submit proof. Everyone in this discussion who did get paid is a loser

    If the card is not working e-mail your claim number from the previous email and ask them to send you a paper check. They should off gave us several options. It’s a rip-off. They can cancel the transaction on their end. It is just messy!

      Agree. It’s all because the $600 IRS reporting threshold this year on paypal and Venmo. Claim admin don’t want more works and more hassles. The good thing is there is NO reporting requirements to IRS on Gift cards, otherwise, we can’t even get emaster/Amazon/Target/Starbucks cards. I don’t know what claim admin would send us in that case, groceries? Or non-grocery items? 😆

    These virtual cards are a disaster. You can’t use them to do much other than bills or Amazon. No virtual wallets, nothing of any utility and these class action administrators should be sued and ashamed. The attorneys involved need to know as well as the judge bc I guarantee that these idiots took their cut in cash and not these junk cards.
