Cura Partners agreed to pay $500,000 as part of a settlement to resolve class action lawsuit claims it omitted certain ingredients from Select cannabis product labels.
The settlement benefits Oregon residents over the age of 21 who purchased cannabis or THC products from Select Elite, Select Pax, or Select Dabbables product lines (including cartridges, disposable pens, and pods) between Aug. 15, 2018, and Nov. 22, 2019, with proof of residency or proof of purchase in Oregon, and where the packaging did not include the existence of botanically derived terpenes and/or medium-chain triglyceride (MCT) as an ingredient in the product line. Around 186,000 allegedly mislabeled units are included in the settlement.
Cura Partners manufactures several cannabis products, including Select-brand lines of vape products. In 2019, the company was acquired by Curaleaf Holdings, which agreed to pay $110,000 to resolve “dishonest conduct” penalties from Oregon’s regulators.
Cura still faced lawsuits from consumers over its cannabis products, including a class action lawsuit over Select product ingredients.
According to the Cura class action lawsuit, products from the Select Elite, Select Pax, and Select Dabbables lines were mislabeled to omit certain ingredients. The inaccurate labels allegedly failed to disclose that the products contained botanical terpenes and medium-chain triglyceride (MCT).
According to c&en, botanical terpenes may be added to cannabis products to provide additional benefits or add distinct flavors and aromas. Although these terpenes aren’t inherently harmful, plaintiffs in the class action lawsuit argue they should be disclosed on Cura’s labeling.
Similarly, the plaintiffs argue Cura failed to disclose the presence of MCTs in its cannabis products. MCT oil played a notable role in the influx in vaping illness cases during 2019.
Cura hasn’t admitted any wrongdoing but will pay $500,000 to resolve these allegations.
Under the terms of the cannabis labeling settlement, Class Members can collect a cash payment of up to $200.
According to the settlement terms, payments may be reduced from $200 if an influx of claims are submitted. Each Class Member will receive an equal portion of the settlement fund.
Class Members have the option to receive an electronic payment through PayPal, Venmo, or direct deposit, or via paper check sent to their address.
The deadline for exclusion and objection is April 29, 2022.
The final approval hearing for the Select cannabis lawsuit settlement is scheduled for May 11, 2022.
In order to receive a payment from the Select product labeling class action settlement, Class Members must submit a valid claim form by April 29, 2022.

Received a check for $38.48 on Sept. 1 2022.
According to the settlement website the payment should be around 161.. I am not sure that was the correct case for that check..
